hi to all,

well i think we are stuck in this situation that make me feel depressed...we have I-130 approved.. my husband send the I-864 already together with the joint sponsor..last April 16, we received a letter from the NVC saying that my joint sponsor didn't include the IRS for 2009 my husband call my joint sponsor and he said that he didn't file for 2009. Now my husband is thinking to give up the joint sponsor and let him sponsor me unfortunately he didnt meet the income requirements...he gonna ask for a letter from his job and gonna send to the nvc.. IS there a posibility of denial on our petition eventhough he have a job?

we dont have anyone to help to sponsor me what should we do now??

we are already 2 years married.. i love him so much

any advice??

Sorry about your situation. Waiting is h3ll. You may have to wait until your co-sponsor files his 2009 income tax return.

Sorry to hear your situation. But the hard part is that without a co-sponsor, it will be very difficult for the consulate to approve your petition unless your husband can show that he earns 125% of the established poverty level or has assets than can compensate for the earned wages. In the eyes of the consulate, they can not approve the Visa if there is evidence that the beneficiary could be become a burden on public resources. As been said already, sorry but you may have to wait until your co-sponsor files taxes.

no he dont want to file it..my husband told me that our co-sponsor didnt tell us that he is married before and dont want to file for it..

I don't understand...what does the co-sponsor's previous marriage have to do with the co-sponsor filing his tax return, or acting as a co-sponsor?

we plan to drop the joint sponsor. But just send a letter from his employment and send the previous 6 months pay stub... is there chance for getting approved??we read in I-1864 that:

23. Current Individual Annual Income

Enter your current individual earned or retirement annual income that you are using to meet the requirements of this form and indicate the total on this line.

You may include evidence supporting your claim about your expected income for the current year if you believe that submitting this evidence will help you establish ability to maintain sufficient income. You are not required to submit this evidence, however, unless specifically instructed to do so by a Government official. For example, you may include a recent letter from your employer, showing your employer's address and telephone number, and indicating your annual salary. You may also provide pay stub(s) showing your income for the previous six months. If your claimed income includes alimony, child support, dividend or interest income,or income from any other source, you may also include evidence of that income.

Don't they typically look for tax transcripts?

now what if the Tax Transcripts were to match the new amount, do know if the Consulate will check with the IRS to verify ?

Why risk doing something that will cause a potential red flag for fraud? Just be honest and get a substitute joint sponsor.

hello thanks for your time to answer this..

we dont have someone to be joint sponsor.. he already ask for the transcrift from IRS and it will take 7-10 days to get it..we gonna send it together with the employer letter and pay stub...Does NVC and consulate consider pays stub and IRS transcript?? on my understanding on what I've read on I-864 #23 they gonna count my husband income for past 6 months and they gonna assume that my husband gonna earn that income in remaining 6 months. because if that will happen my husband gonna meet the income and we dont need to have joint sponsor.
