AOS issued by main petitioner not approved

Hi Friends,

Our Affidavit of Support got rejected as it didn't meet the minimum income requirement according to the

current poverty guidelines. NVA has asked to send additional Affidavit of Support (Form I-864) for a

Joint Sponsor to the National Visa Center to assist in sponsoring the intending immigrants.

NVC letter quoted below:

" The NVC has received the information you have submitted in reference to

the Affidavit of Support. Please be advised that you, as the Petitioner, do

not appear to meet the minimum income requirement according to the

current poverty guidelines to sponsor the intending immigrant(s) for this

petition. The consular officer will make a decision regarding this

requirement at the time of your interview. In order to avoid delays, you

may wish to submit an additional Affidavit of Support (Form I-864) for a

Joint Sponsor to the National Visa Center to assist in sponsoring the

intending immigrants. "

If anyone has faced this or have any idea ,please can you let us know if your original petitioner doesn't get approved do we have to send them another affidavit of support from main petitioner and also from joint sponsor (together in one) or just joint sponsor is fine now?

They only asked for a joint sponsor. But sending the petitioner's affidavit again with the new joint sponsor. It won't hurt anything.

NVC doesn't "approve" affidavits of support. They review them. They reviewed yours and noticed your income does not appear to qualify. They have not required or requested an affidavit from a joint sponsor. They've suggested you "may wish to" submit one from a qualified joint sponsor. They do this even when substantial assets have been shown that WILL qualify the sponsor. If you have studied the requirements and are confident you meet them with income or income and assets, then do nothing. If you don't qualify, send in an affidavit from a joint sponsor who DOES qualify or just send the affidavit to the foreign spouse to carry to the interview. NVC will not hold up your case based on what' in the quoted notice.

What the NVC is doing is actually a bit of a favour. They dont think you make enough, and instead of not saying anything at letting you find out at your interview, they are just giving you a "heads-up". As the letter states its ultimately up to the consular official doing the interview. You might want your non-us spouse to take an affidavit from a joint sponsor to the interview. That way, if the person doing her interview doesnt think you make enough, she can hand over the joint sponsors affidavit (make sure you include the last 3 years of tax transcripts with it).

You COULD mail joint sponsor form to NVC if the rest of the documents have not already been sent. Otherwise, send it to the beneficiary to carry to the interview.

I agree with Push. If your packets have all been sent in, then just produce it at the time of the interview.

If you're still waiting to send in the DS230 packet, then you can add in your joint sponsor's stuff.
