Filing I-130 while still in the foreign country

Timeline

Is it ok that my husband file the I-130 while he's still here in Brazil with me (he goes back to the US in 18 days) or do we have to wait till he gets back there, because of the date? We were planning on sending everything to his parents' house and ask them to put it in the mail for us, so it would be an US mailing address. My only concern is really the date, my husband leaves on the 26th so that's what we put on the I-130 as the last day we lived together, so would it be a problem if the USCIS got the application on the 15th, for exemple? We really don't want to waste any time.

Shouldn't be any problem at all. Also, the I-130 doesn't have to be mailed in from the U.S. - so you could mail directly from Brazil to USCIS if that is more convenient/faster for you.

Yeah no problem with sending from a foreign country. I sent mine our petition when deployed to Kuwait. With the date deal, I'm not sure, but I doubt they will get to your case that in depth until after that anyway. I would just include an evolution of relationship letter in with your petition that explains the date thing. the only downfall from sending from outside the US is the extra time it takes for them to receive it.

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.
