waiver for ban/ outlasted

I have been in the process of getting my fiance over here for the last 3 years. Granted we had disobeyed some laws, as he stayed past the visa waiver 3 month period to stay with me, but we left on our own accord to go live in Scotland. Either way, I ended up getting deported from Scotland and they allowed me three days in the country, so we decided to get married.

Everything went smooth until the interview where he was denied the visa because of his ban. We had been aware that this may happen and put together the packet for the waiver on the ban prior. The first packet was sent through the certified mail company the London Embassy requires, but strangely turned up missing (unfortunately we could not know this until 3 months later because the embassy refuses to answer queries and will block your messages.) We then sent off a replica of this packet, all wet signatures in November. We waited for a response then never got one. Gary's ban ended in January, my lawyer got a hold of the embassy and they said we were right it passed his date. They then had us fill out the DS-156k, DS-157 and the DS-270. On top of that he needs a second physical and another interview.

We have not heard back on the receipt of the additional paperwork they required (which just seemed like updated forms of ones we have previously filled.) We are to wait for a response for the second medical (which I don't understand why they need this, as he has already had one.)

I was just checking in to see if anyone has a case similar, or has heard of a case similar, and if there is anything to do besides sit and wait. And if it does seem reasonable that they are requiring a second medical we he has already had it. And perhaps a wait response for the conjunction of the forms and when to be able to expect a letter for the second medical.

Your profile says K-1 visa but you're saying you're married. Did you submit the I-130 petition?

Agreed. If the consulate asked for a DS-156K then it sounds like it's a K1 visa. If the OP is now married to the beneficiary, then he's not eligible for a K1. :unsure:

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!
