I don't know what effect if any this may have on my Wifes CR1 application, but our 2 year wedding anniversary will be May 17th which is 4 days after our scheduled interview in Montreal. Is there any significance to that? For example, if we wait and cross back into the U.S. after May 17th will she receive a different status or is this something we should discuss with the consulate while we are there?

Thanks

Status is determined at POE. Technically, if you enter after your 2 year marriage anniversary, you are entitled to a IR-1.

Alert the CBP at the border, they might be able to make the update in their system.

Thanks for the replies.. I just wondered if anyone else went through something similar.

I will email the consulate and see what they say.

The consulate won't care - that email will be useless.

What you NEED to do, at the CBP desk at POE -

is to be adamant about IR-1 status - if in fact you go through POE past the 2 year wedding anniversary date.

You can start that convo, at POE, with this -

It's 2 years past the wedding date, we qualify for IR-1 visa type, please change it in your system now? Sure - I'll wait whilst you look up the procedure in your book on how to do.

FWIW, the IR-1 and CR-1 visa types BOTH use the I-130 petition - there is NOTHING MORE to be added to paperwork.

Good Luck !

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

Correct. CR1 visa holders using the visa to enter the US for the first time AFTER their second wedding anniversary are entitled to IR1 status. (ten year green card with IR1 as the noted status).

Facts are cheap...knowing how to use them is precious...
