First off we were about to file AOS tomorrow, but I just found out today I am pregnant. I am the U.S citizen and my husband is the one seeking AOS. We are using my sister as a cosponsor because I am still in school and don’t make enough money. I just got a new higher paying job, but benefits will not kick in for awhile because it is a temp to permanent position. I will have to use Medicaid to cover the pregnancy. My question is will this affect his AOS in anyway? Please help I am a little confused and most of all worried.

Thank you

it shouldnt, and she would still just be sponsoring him, as the baby is not born yet and will be a USC once born. I think there might have been an issue if he was on a means tested benefit, but not if you are.

Not to worry. The affidavit of support restricts the alien(your husband) from using means tested benefits, not you.

This is very confusing. Here in the package that I have it stated very clearly on the first page that if either of us had claimed any kind of benefits in the past then we needed to get a letter from the Foodstamp office stating that they knew we were married and were no longer claiming any foodstamps. Now I know that foodstamps is not considered a public charge benefit so why would they say you had to get a letter stating that you were no longer receiving any foodstamps?
