We live in a country today where the administration is reading Miranda rights to avowed terrorists in the name of equal rights. So, the semantics of a right do not match the reality of a right. The best evidence of this is that gay marriage is required to be tried in court, voted upon in popular elections, and by legislative bodies. If marriage was a right, it would be a right no matter what, with consent of the parties involved, and not limited to two people of any gender.

this is true of all rights recognised under the due process clause. it is not true of rights recognised under the privileges and immunities clause, hence the importance of overturning slaughterhouse. unfortunately, once a government has seized power, it is reluctant to release it. P&I rights are absolute rights.
