Hi guys.....The IMBRA Law does not relate to us....but will it also affect other K visa applications? It's been a month now since my fiance sent the RFE reply. So many things come in my head right now.....I don't want to worry. Last touch was July 21..... :(

jenny and manny - Yes! All K1 petitions filed on or after March 6, 2006 should expect an IMBRA RFE. See USCIS notice: CLICK HERE! If the RFE you received was not due to the IMBRA compliance, then you should expect to receive one.

I don't think there is anything to worry about. It really takes a while for NOA2's to go out of CSC. We had to wait for 100 days before we were able to get ours and that was pre-IMBRA. Then we never got any touches till they sent us an email that we got approved. I am sure yours will be out soon. Good luck!

Since CSC is no longer using the NOA1 date set their priorities on which petitions are being approved, how long it is going to take is anyones guess. Earliest approvals are 60 days after NOA1 longest are now running around 140 days. You might as well throw a dart at a calendar, will give you as good as answer as anyone can.

My timeline is similar to yours and i don't knbow where i am stuck. I am an Imbra, sent in the info which was no criminal record or restraining order. That was in June and the last thing i heard.

Unfortunately, you are affected be IMBRA. Right now it doesn't matter if the law applies in terms of whether or not yet met through a marriage broker. It affects you because the entire system has gone haywire and there is no logical order to anything right now. There are tons and tons of March applicants on VJ who received and returned the IMBRA RFE and have still not been approved.

Only time will tell if CSC will ever figure out how to process these . . .

Unfortunately, you are affected be IMBRA....

This was my first thought when I read the first post. Sadly, even though IMBRA may not apply to your relationship, you will still feel the impact. Processing all but halted for awhile, so it will take some time to recover.

Given the recent activity, hopefully that impact will be lessened in the near future.

I think the delay is because I have a voluntary departure, because a 2 months overstay.

Any opinion?? It has been 6 months and we only have the NOA1..! Its crazy.. My fiance has been lived with me in Mexico, so at least we are together :(

That may be your problem, although normally that isnt an issue until you get to your interview.

Some people have had major delays in getting their NOA2 but there is no hard evidence that I am aware of that it was directly related to that. Security checks and or administrative reviews are the usual causes and I have yet to see any real hard evidence (other than a name showing up on hit list) for the reason for delay experienced by some and not others.

The delay because of an overstay usually transpires once you are declared inadmissable and you have to do the waiver process.

Dwar - I think the same as you do and I hope you are right - otherwise we are both in for a much longer wait than we thought . . .
