It's possible, but you have to talk with a CBP officer at the POE when you make the jump.

Be prepared to show the marriage certificate , then if they are still confused, ask them to open the sealed envelope and review the paperwork inside, checking the marriage date against the Interview Date. It can be done, but be prepared to pulled aside, perhaps even put into secondary inspection, and talk with a big boss there. This will add time to your POE, but IMO, it's worth it.

If the consular officer feels that this is not a bonafide marriage then he won't issue me a visa, he will put me under AP. Anyway thanks for your input I will fill up my timelines later.

Good advice except the officer needs to check the marriage date against the US entry date. The visa will not be changed and doesn't need to be. What needs to change is the status, so that a ten year green card with IR1 status is issued.

A person can correctly be issued a CR1 visa and still have IR1 status on entry based on the two-year anniversary passing prior to entry.

Alternatively, the visa holder could return to the Consulate to have the visa corrected.

No, not yet.

The green card is issued after POE date. After reading push's reply - I'm starting to question exactly what was printed on the visa, itself - as 'green card <> visa stamp', usually. There are some things that will 'nominally' line up - ie - CR-1 label with CR-1 status with 2 year Conditional Status on I-551 Green Card, but for this poster, somethings wonky.

I have to assume something went wonky on interview day, and after interview day, where some clerk at the Embassy didn't twig to the concept that the DATES qualify her for an IR-1.

She has a good chance of getting this fixed at the the POE - but if she doesn't get it fixed there,

she'll have another chance to get it fixed after it is issued.

If she's not left yet - she can go back to the Embassy and 'get it fixed'.

Just for clarity, "I love you, you love me..." is not a requirement for a bona fide marriage in this context. Though it may be a personal requirement for you and me, it is not for immigration purposes. The standard is that the relationship has to be clearly about more than obtaining an immigration benefit, period.

Most likely sloppy work on the part of the consulate. You can return and get it corrected or address it at POE...

11-30-09: GOT GREEN CARD in mail!!!!!!

Citizenship Process;

1/11/2013: Mailed N400 to Dallas Texas

3/11/2013: interview.. Approved

4/4/2013. : Oath! Now a U.S. citizen!
