I-130 question

Hi,

my wife is a US LPR and will hopefully be naturalized later next year. I will be leaving the US to fulfill whatever is left on my 2 year home residency requirement (J-1). Fingers crossed, I will have fulfilled the requirement by the time she becomes US citizen.

My wife was advised by an attorney to submit an I130 while she is a LPR. We know that the case will be given priority and the petition will no longer be subject to numerical limit when she becomes a citizen. Granted, she does petition now, does she have to submit additional papers and/or call once she becomes naturalized? Will this shift cause a delay?

Lastly, what is your take on petitioning while a LPR who will become a citizen before a visa number becomes available?

That sounds sensible, you never know what may delay citizenship and you are in the system and can upgrade.

Your wife notifies USCIS she's now a citizen, sends a copy of her Naturalization Certificate and asks that the petition be upgraded to one from a Citizen.

Hi , I was in the same situation...My husband was a LPR when he applied on September 1st....the same day He applied for his citizen..his process was done by November 16th and on the 18th he calls to USCIS to upgraded my petition and they send him an email asking for a fax with his copy of the naturalization certificate..he also mailed it just to be sure a letter requesting this with a copy of my NOA1 and his Naturalization certificate,...and on the 20th my petition was upgraded to immediate relative..and on January 27th I receive my NOA2 of approval...so as you see everything was really fast... ..

So it appears that the upgrade will not delay things.

Again, what is everybody's opinion on LPR submitting I-130 roughly 1.5 years before being eligible to apply for citizenship?
