hey, i am - probably as everybody here - in a delicate situation and have been stressing out to the extreme over it.. i have married USC 9/06 bona fide, had our interview 9/07 and was asked to send more pics as the evidence. did so the very next day, but what i found out recently was that it wasnt put in my file until 7/08. our marriage hit rock bottom, although we were friends, fiances and spouses for many years and last year due to his infidelity i have decided to leave him and moved to another state. we have not legally separated or divorced, because well, what a big decision, something what cannot be taken back if we decided to get back together.. we have been in touch, but havent seen each other in 9 months. i got an attorney and sent letters to the senator and ombudsman and got a notice to appear at my local office for the interview... my husband is flying in.. but gosh, what to do? why is there another interview and what to tell them, how to explain we do not want to divorce until we are sure that's the right thing? we have taken that separation time so we can both grow and mature back into married life.. but obviously, if we tell the IO that we are not together and havent been in 9 months, how can they approve the I485? i cant afford an attorney.. had one that did follow up inquiries and i was very dissapointed that it cost me so much money to have her send three emails that i could have written.. any suggestions? has anyone been through this? because i have been trying to find info about similar cases but not successfully. i have been in the country legally all along. i have lived here for 4 years, i cant just pack and leave if this gets denied!! please help..

You are applying for your green card and it is just now being adjudicated?

Do you have all the evidence of a bonafide marriage, i.e., marriage certificate, joint tax returns, joint bank accounts, utlility bills, names on leases, and so forth? If not, and you never did, then the interviewer will ask a lot of questions of both of you. Just tell the truth, both of you, and pray hard.

yep, i have everything.. we truly were married because we fell in love.. the problem is we are physically separated, not legally, but with no proof of working on our marriage. first interview went well, we were interviewed separatelly, which i find weird. we didnt have pictures.. we were naive and thought by showing everything else they would see the truth i guess?? i wish i knew then what i know now, after 3.5 years of being "pending allien".. what can they do when we are going through problems but are not giving up and divorcing, but letting the time solve it and heal our marriage? im not worried about proving bona fide marriage at all, i mean the beginning of marriage, what can i prove now? gosh..

anyone can share their knowledge or opinion? i have been reading everything i can find about this issue and have found articles saying the I485 interview's purpose is to prove the marriage was entered into bona fide and the IO need to stay away from predicting the future of the marriage and the viability.. we have no intentions to divorce, we just need to give each other space to make our future better and marriage stronger.. no infidelity of course.. we are not legally separated and do not plan to do so.. we are currently in the phase of figuring things out and finding ways to make it all work. thoughts?
