Hello All,

I am the 2nd person to Petition for my fiance'. Two years before me he had been the beneficiary of another woman that abandoned their relationship. However my fiance' did not notify anyone and went to his interview very unprepared to see what it was like and if there was still any chance of getting to the USA. He answered the CO honestlty about the failed relationship and the petition was revoked for lack of evidence of an ongoing relationship. At the CO's suggestion he wrote to USCIS to 'cancel' the petition.

Since this is his 2nd time I imagine that doesn't look good for us. We have been in AP almost 16 months which seems longer than normal. I understand each case is unique but I am wondering if there are others that have a similar experience and if they also had a long wait on AP.

Are we just unlucky or are we under heavier scrutany because it is his 2nd time?

Strange - he couldn't cancel the "petition" - as it wasn't his to cancel. The only thing he could do is remove his application for the visa.

From where your coming from - I have seen AP waits that long. You will just have to wait and see.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I did a poor job explaining -- at the CO suggestion he wrote an email to USCIS saying the realtionship had ended, and he added that the petition should be 'cancelled'. (his words) This happened after it was revoked at the embassy so if USCIS cared about what he wrote or not I do not know. I am just fishing in the dark for why we are still in AP... but I suppose it is just because he is a young Pakistani male and sometimes it just takes a long time.

It is probably a bit of both. Hind shight is 20/20, but I would not have even tried a k1 (though you may still be approved. . .) a CR-1 would have been more likely to be approved with this history.

As others have pointed out, AP can easily last this long in Pakistan. It is time, though, to start getting on top of things with a Senate/House liaison to do inquiries. Do not let them think you have lost interest.
