Hi,

My husband and I will be filing the AOS forms around mid Feb and I had the following questions regarding the form I-864:

1. Since we will be filing for AOS before he files his 2009 tax return, is it ok if I don't include 2009 info and just say that the tax docs are included for the years 2008, 2007 and 2006? will that cause an issue?

2. Is it sufficient if we include the tax return copies, his W-2 docs and his pay stubs? or do we definitely need the tax transcripts from IRS? If yes, how do I get them for IRS?

3. My husband will be my sole sponsor and his annual income is 50000+, so my understanding is that form I-864A is not needed for me. Is that correct?

AOS timeline:

1st March 2010 - AOS packet received at Chicago (I-130, I-485, I-131, I-765)
9th March 2010 - Checks cashed
12th March 2010 - All 4 NOA's received
19th March 2010 - Applications touched biggrin.png
19th March 2010 - Received Biometrics letter for 2nd April
2nd April 2010 - Biometrics done
19th April 2010 - Received interview letter for May 21st biggrin.png
6th May 2010 - All applications touched. Status of I-765 changed to document production, status of I-131 changed to post decision activity.
10th May 2010 - Received approved AP in mail
21st May 2010 - AOS Interview, IO said he will approve the case... waiting for Green card smile.png
27th May 2010 - Received EAD card
17th June 2010 - Approval notice for I-130 received. Also received "Welcome to USA" letter biggrin.png
28th June 2010 - Finally received my GC.... Praise be to God smile.png

16th March 2012 - Sent ROC package
21st March 2012 - NOA1 date
20th April 2012 - Received Biometrics letter for 16th May

December 2012 - Received 10 year GC

01 Nov 2013 - Sent naturalization package

18 Feb 2014 - Oath ceremony done, naturalization complete!!

You can submit the tax return and all the supporting documents that go with it (W2, etc) or you can get the IRS transcripts and here is how: IRS Tax Transcripts:

Yes it's fine. According to this: http://articles.moneycentral.msn.com/Taxes/taxcal.aspx the deadline for filing 2009 taxes is April 15 so I would assume that they can't "force" you to include 2009 until after this date.

2. Is it sufficient if we include the tax return copies, his W-2 docs and his pay stubs? or do we definitely need the tax transcripts from IRS? If yes, how do I get them for IRS? IRS tax transcripts are free from the IRS, the phone number to request them is: 1-800-829-1040. If you include tax returns, then you need w2, 1099's, and the schedules to be included. The IRS transcript just seems easier to me 'cause you can't forget it when it's all there. Also, on the thread below, it tells you where on the IRS transcript you get the income info from (post 14)
