You may want to check out the timeframe people are talking about so you understand that it is likely you will have to wait about 2 years before you will get a K1.... about 1 year for him to become USC and then 9 months to a year for you to get a K1....

Thnaks everybody,

I think the best way forward is for my fiance to apply for his citizenship and then go ahead and file for a K-visa for me. One last question, once the k-visa is appoved do we have to get married in USA or can we get married elsewhere??? It has always been our plan to get married in Nigeria which is where our parents are from.

Thats where the citizenship came in......

Nothing to do with immigration or anything like that, but I think when the time comes for you to deliver the baby you'll want to be around friends and family...and the Doctor you'll be seeing throughout your pregnancy, not somewhere strange.

Plus having a baby in the U.S. is VERY expensive if you do not have good medical insurance. It doesn't add up to me why you would prefer to give birth in the U.S. Plus timewise, you really are cutting yourself short. Many airlines will not allow you to fly after a certain time and I don't think a citizenship application and K-1 could be processed within that timeframe. Sorry to be such a downer!

How long will it be until your fiance can file for citizenship?

I guess you already know that he cannot move with you to Britain because then that would jeopardize his eligibility to file his citizenship application.

There was a thread posted a while back about a woman who was engaged to a permanent resident. She came to the United States on the VWP and apparently stayed until he got his citizenship. Perhaps some clever searches will unearth that thread. I know Meauxna commented in it and I just read it a few days ago, but I can't find it...

You might also try getting a student visa or a work visa. With a child, there's an even greater challenge with that, but it is possible. In fact, a friend received visas for himself, his wife, and his children to do his PhD in Business. Maybe that's possible in your situation?

What you are sugesting the OP do would be immigration fraud..... To enter the USA using a VWP with intent to remain is illegal...

True but the OP already said she wanted to come here & have her baby so it would be a USC. She didn't seem too concerned about the (il)legalities of that.

I believe it's all looking like fraud...

No.

I'm not suggesting she do anything close to immigration fraud. Actually, I suggested that she should do a search for the thread in order to read it.

What I have a problem with in this situation is that the OP would attempt to have a baby in the United States possibly without having health insurance. That, in my opinion, is grossly negligent and I would hope that American taxpayers, like myself, would not have to pay for that.

I'm curious, Kezzie: Did anyone tell you that it was illegal to enter the USA using a VWP with intent to remain? Did you ever pose that question to anybody? I've been wondering how some people do that or if they were simply ignorant to the immigration process before that.

I did not come to the US with the intent of remaining I came to stay with family friends to recover from major surgery.... I met my husband here and we decided to get married... I tought I would have to return to the UK and wait for a visa...when we went and spoke to an immigration officer at Boston we were told there was no need for me to return and file for K3 as I was legally addmitted to the States I could file for AOS and I-130 together....

Why would I know anything about immigrating when I have never thought about moving to another country to live.... I have always come to the States on a VWP as do most tourists from the UK....

He is able to file for citizenship now actually. He has been in the US for 9 yrs, and he has just been lazy about appplying till now. After all the comments i have decided to stayin england and give birth and then see what happens with the visa situation.

well two simple and good suggestions:

First have your baby in UK. you know why? your baby would have a british passport. Now once you deliver the baby, both of you can go to USA since both of you would have VWP facility.

Once you get there, you can get married in USA with your fiance and remmember, your kid would be his baby too so he can apply for AOS for both of you.

I-130 petition in DCFR Tokyo: March 14th 2004. Case reffered to DHS USCIS

Four visits to japan in 2004: Oct 2004, wife got pragnant.

Wife/Fiance left USA and moved into Japan: Feb 5th 2005.

Baby Born: June 24th 2005(Japan)

I-130 denied: July 17 2005(Divorce was declared not valid)

Refiling Divorce: oJuly 17th 2005 NY State.

Divorce granted: Nov 17th 2005

K-1 application: Mar 1st 2006

Approval: May 23rd 2006

US consulate RFE: June 15th 2006

The comments i made about wanting to give birth in US were just so i could get advice on it and any necessary information and details regarding the matter. I do not intend to commit any kind of fraud and at the end of the day i want to put the welbeing of myself and my baby first. I have taken on board all the comments, positive and otherwise and i'm grateful. Before i came to this site i had no clue about visas to america so forgive me for my ignorance in some of the posts!! But I WILL NOW GIVE BIRTH IN UK!!!.
