Hi,

I got my K1 visa approved a couple of weeks ago. My fiancee currently lives in a shared rental but we just secured a lease on our first apartment together. She's moving in next weekend, 2 weeks before I fly out to join her in the USA...

My question is this, what do I need to do? Who do I need to contact and what form? AR11? All our paperwork points at her current address but I won't be joining her there now, still gonna be in San Diego (literally a couple miles away from where she is now!!)

I'm flying into LAX and want everything to be in place for the Border officers....

If anyone can help that would be most appreciated!

Thanks

Simon & Cassandra

I would'nt worry about it, I would just go with the address she has on the paperwork, and change it after you enter. She should probably wait to change it as well on her ID, and everything else she has...

That's my advice...

This is just about the perfect time to move. Now that you have the visa, your next contact with USCIS will be to file for AOS, and you have to give them your address all over again. For AOS, it will be the new address. You don't need to file a change of address at all.

A new place! Exciting!

 - according to the rules, all non-U.S. citizens who move within the United States and its territories must submit a Form AR-11 within 10 days after completing the change of address.

Sponsors have 30 days to change the address if they move (from the date of the move).

It can take up to 90 days after arrival to AOS.

So I would recommend you do the AR-11 when you arrive at the new address (it will not matter at the POE).

Your fiancee will have to submit an I-865 (within the 30 days of moving)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

WARNING: Phrases in this post may sound meaner than they were intended to be. Read the Adjudicator's Field Manual from USCIS

You don't need to do anything if your faincee has not yet moved into the united states with you . Wonce you arrive into the U.S.A. you then have residence into the United States . And you use that address , when you file the AOS . But if the alien moves while into the united states you must file the form AR-11 Alien Change of Address with USCIS within 10 days . And a fiancee of an american citizen does not have to file the form I-865 - Spouncer Change of Address . UNLESS , you have moved to another residence within the U.S.A. prior to filing the form I-864 Affidavit of Support ( (1) You file the I-864 Affidavit of Support , then (2) you move to a different residence .

But if you were already married prior to entering the USA , then you must file the AR-11 and the I-865 . Only because you were required to adjust status before entering into the USA , and the I-864 was allready filed before the entery into the USA .

Thank you all for your help and the speedy responses!! I tried calling USCIS and the NVC and noone seemed to know anything - I guess because I'm already approved so we have no pending cases YET! Not until we file for AOS...

I'm going to get my fiance to get a notarized letter from her work and maybe bank too to prove a new address and send it to me so I can show the officer at POE if needed... Belts and braces! Apart from that I guess there isn't a lot we can do!

What address do I put on the immigration form on the plane? IS there even a form for me to fill out? the little green paperthing? What about ESTA that's just for visa waiver right so wouldn't be applicable?

I guess I just fill out a white customs form?

Exciting but still many hurdles to come!

Yes, that was the reasoning in my previous post - with no pending cases, what exactly are you supposed to change your address on.

When you come in you will fill out the I-94 for people entering on a visa (so the opposite of what nearly everyone else on the plane will have). I cannot remember for the life of me if it's the green or white, but I'm sure someone will mention OR the stewardess will be able to tell you. Since you are entering on a visa and NOT the visa waiver program, I don't think you do ESTA either. You also fill in the customs form, for a total of two.

Together soon! Have a safe and pleasant journey
