Hi all,

due to some circumstances, I'm going to slightly overshoot my I-94 expiration date and not be able to file my AOS before then.

I'm lacking 1 tax return page from the IRS, and the appointment with the civil surgeon.

Now I wonder, do I wait until I got the final documents, or do I send the package off now and wait for the RFE?

I could really use some advice here.

Our K1 Visa timeline

03-28-09 : I-129F mailed to USCIS

03-30-09 : I-129F received at USCIS

03-31-09 : check cashed by USCIS

03-31-09 : NOA1 email

04-02-09 : check cleared at bank

04-04-09 : NOA1 hard copy received

07-21-09 : Touched

07-22-09 : NOA2 email

07-25-09 : NOA2 hard copy received

08-06-09 : Case received at NVC

08-07-09 : Case forwarded to US Embassy in Brussels

08-19-09 : Packet 3 received from US Embassy

09-03-09 : Medical completed

09-03-09 : Packet 3 checklist mailed back to US Embassy

09-10-09 : Interview!

09-17-09 : Turn in two missing forms, Approved, Got the VISA!

10-21-09 : POE Washington DC

11-08-09 : Married

Just file as soon as you can - if it's just "slightly" you shouldn't have to much issue.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Thanks for the fast reply.

By slightly I mean that I will have my civil surgeon appointment and missing tax return form about a week after the expiration date.

Our K1 Visa timeline

03-28-09 : I-129F mailed to USCIS

03-30-09 : I-129F received at USCIS

03-31-09 : check cashed by USCIS

03-31-09 : NOA1 email

04-02-09 : check cleared at bank

04-04-09 : NOA1 hard copy received

07-21-09 : Touched

07-22-09 : NOA2 email

07-25-09 : NOA2 hard copy received

08-06-09 : Case received at NVC

08-07-09 : Case forwarded to US Embassy in Brussels

08-19-09 : Packet 3 received from US Embassy

09-03-09 : Medical completed

That would pose no issues.

(you will be out of status, but ICE won't be kicking down your door)

Just don't delay :)

It took us three months to get all the necessary documents from my husbands country for us to be able to file & there were no questions with regards to this situation.

04/16/2009 Received pink notice of medical exam needed

04/17/2009 Had medical exam done by Civil Surgeon (have to return on Tuesday 04/21/2009 forResults)

04/24/2009 Papers delivered to Lees Summit (MSC) :o)

05/07/2009 Received email from CRIS that EAD card has been ordered & should arrive within 30 days

05/08/2009 Received email from CRIS that EAD Approval Notice was sent

05/09/2009 Received EAD card in mail YAAAAAY

05/12/2009 Applied for Social Security Card

05/15/2009 NOA received with I-485 interview date 07/20/2009

07/21/2009 Email received " Card Production Ordered " YAAAAY 139 days!

07/24/2009 Welcome letter received! & Approval of I-130 also received! Yaaay

08/04/2009 Green Card received! Hoooraaaaay!!
