Timeline

When may a K-2 Visa holder acquire his social security number? Must he first receive his work authorization card and then apply with social security or may he apply with social security beforehand...or does the order matter? Thank you.

K-2's are not eligible for a SSN card until they are a Permanent Resident (Green Card holder).

June 10/04... K-1 Interview - APPROVED!!!!

July 31/04... Entered U.S.

Aug. 28/04... WEDDING DAY!!!!

Dec. 10/04... AOS Interview - APPROVED!!!!! (Passport stamped)

Sept. 9/06... I-751 sent to NSC

May 15/07... 10-Yr. PR Card arrives in the mail

Sept. 13/07... N-400 sent to NSC

Aug. 21/08... Interview - PASSED!!!!

Sept. 2/08... Oath Ceremony

Sept. 5/08... Sent in Voter Registration Card

Sept. 9/08... SSA office to change status to "U.S. citizen"

Oct. 8/08... Applied in person for U.S. Passport

Oct. 22/08... U.S. Passport received

DONE!!! DONE!!! DONE!!! DONE!!!

Apr. 6/05... DS-230, Part I faxed to Vancouver Consulate

May 26/05... K-2 Interview - APPROVED!!!!

Sept. 5/05... Entered U.S.

Sept. 7/05... I-485 & I-131 sent to CLB

Feb. 22/06... AOS Interview - APPROVED!!!!! (Passport NOT stamped)

Dec. 4/07... I-751 sent to NSC

May 23/08... 10-Yr. PR Card arrives in the mail

Mar. 22/11.... N-400 sent to AZ

June 27/11..... Interview - PASSED!!!

July 12/11..... Oath Ceremony

K-2s must have a green card before being eligible for a SSN

They must have their EAD or GC before being able to apply for a SSN.

In the case of my wife's K-2, we are going to apply for his EAD along with the AOS documents.

He is 2 years old and it just wouldn't be right for him to be able to obtain a SSN before he has work authorization !!!

I mean, just because I, as a USC, was able to obtain a SSN when I was a baby does not bestow any extra priveleges upon a K-2 coming to this country.

I think this makes perfect sense; we wouldn't want the 2 year old to start working illegally before he obtained the work authorization. That wouldn't make sense.

FYI...for tax purposes, you can claim them as a dependent on your taxes. Where it asks for an SSN simply write in "pending". Go tot a local SS office and they will give you an official letter that this person cannot receive an SSN until they have an EAD or Green Card. Attach this to your tax return and file a paper return (you cannot file electronically if anyone is missin an SSN)

I was intending to get him a ITIN for use in lieu of the SSN for me to claim him as my dependent.
