I live in St. Louis and don't recall them calling it a terrorist attack. Just a disgruntled worker. Can't blame him for the disgruntled part. It's the aftermath I am having trouble with.

Not terrorism if you ask me.

If one gets charged with making "terroristic threats", can it fairly be said that the law is alleging that person is a "terrorist"?

This is in my local paper today. The alleged perp is not Muslim.

NEW BRUNSWICK -- A South Brunswick man was charged with attempted murder for the drive-by shooting of a man in New Brunswick early Monday.

Melvin Hyman, 34, of the Dayton section of South Brunswick, was arrested Wednesday after he surrendered to authorities at the Middlesex County jail in North Brunswick for charges unrelated to the shooting.

In addition to attempted murder, Hyman faces charges of making terroristic threats, unlawful possession of a weapon and possession of a weapon by a person previously restricted from having a firearm, police Lt. J.T. Miller said.

Here's another one, also local.

Police on Wednesday charged a 23-year-old Hopewell Township man with robbing the 7-Eleven store at gunpoint at around 4 a.m.

Brian L. Estlow was arrested at his Cubby Hollow Road home sometime between 4:00 and 4:30 p.m. after police spotted the alleged getaway vehicle, a white 1993 Nissan Sentra, there.

Det. Jeffrey Bordley charged Estlow with robbery, terroristic threats and several weapons offenses.

And another...

Erin Lockwood, 35, of Vineland, was arrested early Thursday at her home on the charges of terroristic threats and stalking, accused of leaving 24 threatening messages on the victim's voicemail. Bail was set at $10,000.

In New Jersey, there are three elements to a terroristic threat which include:

(1) The accused person actually made a threat

(2) The threat was to commit an act of violence

(3) The accused had a purpose of terrorizing or acted with reckless disregard to the risk that a third party would react with fear

Terrorist threat is a term of art having nothing to do with the terrorism besides sharing the same the root word.

Capital offense doesn't mean the crime happened in Washington.

Conviction doesn't mean it something you believe in.

A grand jury isn't a large jury.

A hearing can happen take place for the deaf.

Misdemeanor isn't just the stage name for a stripper.

aj ... a little more information ...

this is typically a 3rd degree crime.

there is also in NJ a merge and severance of charge. the doctrine of merger dictates that an indictment for terrorist threats merge into a conviction of an included higher grade offense. Example, a conviction for terroristic threats will merge into a conviction for first degree robbery as a lesser included offense. this means a person can't be penalized separately for each offense.

Merger doesn't work it the other charge is for a lesser crime.

personally i think the ideology behind the attack is what determines if it was a terrorist attack or not. if done in the name of a religion, or to further a political agenda, then it's terrorism. if it's a disgruntled worker (christian, muslim, whatever) and it's not to further some political or religious agenda, then no, it's not terrorism.

the "terroristic threat" is a good catch-all that can even be used for domestic violence cases.
