Is the bit about "She called me while they were questioning her" possible? I assumed when you were getting interrogated in secondary that you wouldn't be making phone calls.

I never tried it when they were questioning me, but I was too busy talking to the nice man to make a phone call. :blush:

Didn't he say that they were yelling at her when she called him (or he called her) - when I read that I thought - hmm yeah, that would make them yell at you.

your not allowed to make phone calls..i was in secondary twice in the last year..they outright refuse it. even if you tell them to call someone to verify something they outright refuse it.. and that was at 2 diff border crossings. also you are not allowed to even go in with a cell phone they make you leave it in your car. i'm guessing the rules are the same no matter what poe it is.

I think it's possible that she called him, I mean if they didn't take her phone away from her and she grabbed it and hit speed dial - would they wrestle her to the ground and take it away from her?

Well I mean they probably would - but they may not have on this occasion :hehe:

I totally agree with you about all of this. The fact she has an American husband and a 1 way ticket is more than enough to arouse suspicion and deny her entry.

Just to play devils advocate a little, I had a close acquaintance and classmate in college who was Muslim and born in the region of Palestine. She had been living in Canada for several years and had Canadian citizenship and a Canadian passport. However, she was openly Muslim and wore a headscarf. And, as you know, Canadian passports list ones place of birth. Whenever she would cross into the US by land, with her passport, she said she would need to give herself at least 5 hours. Each and everything she crossed the border, according to her, they would pull her into secondary and question her for hours on end. She said they would ask really offensive questions like if she knew how to make a bomb, if members of her family were terrorists, just very strange things to ask a 21 year old Canadian citizen, regardless of her place of birth. Now, I know this is a completely different situation. She didn't have an American husband and always tried to act in a way that wouldn't draw attention to her, but it always did. So, I guess what I'm trying to say is that some US border guards do play the race card. They do racially profile people and they do jump to conclusions based on ones race, religion, and place of birth. In the article there was a lot more at play that seemed to trump any religious considerations, but in the case of the woman I just described, the only thing against her was where she was born.

When I was in secondary activating my K-1, there was a Muslim woman in there too. She had a one way ticket and like 6 bags. I think her husband was in the US too. Weird how coincidental that sounds.

She used her cellphone in secondary and man did she ever get yelled at for it. I probably wouldnt have missed my plane if she didnt go up and question the security officer 4 times. Ugh.

The person before me was allowed to use their phone though, which I thought was weird. She had like no bags with her too, just a small carry on. she was even sat down and questioned. Secondary sucked that day for me :lol:

I read so many horror stories on here (and other forums) before I crossed the border activating my J-1 status that I hired a lawyer to represent me. I drove down to Fort Erie, stayed overnight in a hotel and then drove down to the border the next morning. Wthey sent me into the building for processing, she was there waiting for me. I didn't end up needing her, as things went relatively smoothly, but the comfort added just knowing that she would be there to stand up for my rights if they tried to pull any funny-business was well worth the money. Maybe that's why it went so smoothly... they saw her coaching me before I was called up to the window :)

I know a girl born in Iran that had the same problem. She was asked the same questions and always gave herself plenty of time to cross the border. So it for sure happens, no doubt.

I just think in this case the issue was immigration and they completely overshadowed that by the whole muslim side of the story.

Guess all those times they questioned me at the border, it was because I was white.

I totally thought it had something to do with my fiance living in the States... but now... I'm starting to question it.

Hmm the very nerve of those border patrol officers. I get questioned about the purpose of my visit, how long I'm staying, where I work etc.....they are clearly targeting me unfairly because I'm an Italian male living in Canada. And they singled me out because I wore jeans and a T shirt. That does it....I'm calling a reporter. :bonk:

While I can see why there are good reasons to deny her entry, I can see why she's feeling bad. It's a handful of days after the underwear bomber, and she's never had a problem in the past. All the articles say she's traveled regularly between the U.S. and Canada, so presumably, even though she's married to a U.S. citizen, she hasn't had issues visiting and her evidence of non-immigrant intent in the past has been sufficient. And she returned with all the information they told her to have, and they still wouldn't let her through. And no one's said to her that the problem was that they suspected her of immigrant intent -- those of you denied entry surely were told why, and that you'd have to get a fiance or spousal visa -- and it's curious that no one seems to have mentioned that to her.

In other words, it doesn't sound to me like someone whose knee jerk reaction was to cry discrimination and I'm a little surprised at the consensus developing here. I don't doubt that they pulled her aside because of the spousal thing, but I can also see why after coming back to the airport with all the documentation they asked for and still getting turned back she'd start to consider other explanations.

Actually the one time I came close to being denied entry, I asked the BG what the specific issue was (had I been visiting too often? Didn't have sufficient proof of ties with me?) and she just said "because that's the way it works, honey". Uh, okay. And this was a full year after my I130 application had been sent in. I pointed out that I had an application in process too.

So, frankly, it really depends on the BG on whether you get a helpful answer or not and get admitted or not, even after presenting everything they ask for. Did it help that she was visibly Muslim? Probably not. But then my being self-employed never helped me much at the border either.
