HELP WITH 1-130 FORM

Hey Guys,

We are looking through the form I-130 section 22 and this is what it says...

22. Complete the information below if your relative is in the United States and will apply for adjustment of status.

Your relative is in the United States and will apply for adjustment of status to that of a lawful permanent resident at the USCIS office in: _________(City)____________(state)

If your relative is not eligible for adjustment of status, he or she will apply for a

visa abroad at the American consular post in: ___________(city) __________ (state)

So my question is...does this question apply to me at all...as I am living in Canada...and my husband is a USC whose filling out the forms...I am not in US and I will not apply for AOS etc...I know this doesn't apply to us...and we should put N/A on both parts of the question ...but my darling husband wants a confirmation!...so please advise!!

2008 Aug 9 -- He Proposed, I said YES !!

2009 Aug 21 -- Officially got engaged in front of family!

2009 Nov 22 -- We got married`

2010 Apr 01-- RFE notification via text/email =( [on my birthday]

2010 Apr 15-- Touched

2010 Apr 21-- Text recieved by USCIS indicating Approval-- NOA 2 hard copy mailed out Apr 20--[unbelievable how fast they responded with the approval in 4 working days]

Your I-130 was approved in 96 days from your NOA1 date.

are you sure?? but it says if I am in US at the moment...then I should fill...but I am not...so regardless...I should say Montreal, Canada??

Sorry, just trying to make sense of this form!

the answer to this question has been heavily debated

when i filled out mine i left it blank and i got noa2 with no rfe

some ppl put the country of their spouse in the second part of the question and they get their noa2 with no rfe pertaining to that question

the question is very poorly worded and i think the relevant authorities should consider revising it

I864 delivered November 2nd.....nvc logged it on November 5th

DS230 delivered November 6th.....nvc logged it on November 12th

Well, I sent my application following the form example here on VJ. Check the examples form.

Do whatever makes you comfortable. For me it makes sense, as I am not in the US and applying for visa abroad. (sice the visa will be issued in my country).

Didn't get any RFE so far.

Well, I sent my application following the form example here on VJ. Check the examples form.

Do whatever makes you comfortable. For me it makes sense, as I am not in the US and applying for visa abroad. (sice the visa will be issued in my country).

Didn't get any RFE so far.

It just seemed right to me to add my Consular Information, as the example forms says.

I guess we will put it in...just the whole wording of the question and all...freaks me out...as I have got nothing to do with living in US or AOS...but I guess as the example form says and others...then let me put it in...and go from there...

My wife is a USC and I'm working in Saudi Arabia. Here's mine:

...for adjustment of status to that of a lawful permanent resident at the USCIS office in: ____N/A_____(City)_____N/A_______(state)

This refers to the petitioner. My wife (petitioner) is a USC already so no need for her to change her status to permanent resident

...he or she will apply for a

visa abroad at the American consular post in: ____Riyadh_______(city) __Saudi Arabia______ (state)

This is for the applicant. This is the embassy of our choice where I (applicant) want my visa to be forwarded.

We had no problems in our I-130. Hope it helps. Good luck! :)
