I posted in the September 2009 filers forum but didn't get a response, so I thought that I would create a thread to see if someone can answer my question. I have noticed that some people who have filed the same time as us have already gotten their approvals as well as couples who have filed after us. How are the applications processed, are they processed in date order?

Should we be concerned or expect an RFE or interview...?

I do not know how they go about doing things, but I do know that each applicant is different. Check the timelines to see if you are within the average. I know our approval from USCIS took 3 months-but I was filing for k-1.

I would say give it another month- as things might have slowed up due to the holiday breaks and such. If you haven't heard anything by the end of January, do some inquiring.

The applications, yes, are processed in the order received. However, there are dozens or maybe even hundreds of different people processing applications, and they each take big piles at one time. If they have difficult cases that take more time (or if they have a vacation, etc),your application may be left at the bottom of someone's pile and may take more time then others who are working through their case piles faster.

K1 is quite different from ROC.

It seems to depend on your service center as well. CSC has been approving ROC applications at a much quicker rate than VSC. At the same time, at least with VJers, there are fewer applicants going through CSC than VSC.

11/2004 - Met in Brazil

09/2006 - Apply for K1

03/2007 - K1 approved

04/2007 - Apply for AOS & EAD

07/2007 - EAD approved

01/2008 - Conditional Residency approved

11/2009 - Apply to remove conditions

02/2010 - Permanent Residency approved

11/2010 - Apply for Citizenship

03/2011 - Citizenship approved

07/2011 - Moved back to Brazil

You been waiting for 3.5 months (just like me): average is 4-4.5 months. You do the math.

Well thank you but that wasn't my question. I asked if they processed the apps in order which received. I'm not complaining about the wait, I just was curious as to how people who filed after us were already getting approvals from VSC.

Look at any thread for any month and the answer is obvious: generally they go chronologically, but if you look too closely then you will notice that it is somewhat random. You should get approved soon and no longer wait does not mean you should expect RFE or interview.

Yeah, background check can make it drastically different, but even if you disregard checks and complicated cases, it still doesn't go one after another: it follows chronological order in general, but within that particular month it seems random.

1. This process is purely done by humans, and each person's file will end up with different person (maybe) and therefore, your application being approved quickly or not depends on the officer's diligence.

2. In addition, some people have been told (info from my lawyer) that they take longer than others for the FBI to clear their name while their application is approved and waiting FBI feedback.

3. The evidence you sent may be too little/too much that they will spend more time going through it....

4. (any other reason you can think of)...

Here's a positive though though, if they are approving people in your timeline and you haven't heard yet, then no news is good news. If they wanted more evidence, then you would've received an RFE or interview notice. USCIS claim it takes 6 months to process an application so I don't think you should worry too much at this point.

Thank you very much, that does make me feel better. As long as we stay within the timelines I'm not worried, I was just a little freaked about seeing people get approvals who applied after us. I'm still hoping that we hear something soon, good or bad.....

VSC is too strange to comprehend. I saw an hour ago or so someone in November got approved at VSC..... That was under 2 months for that person. So in other words, they skipped most of september and all of October, and decided to approve someone in November. :blink:
