My fiance just went through his interview at Casablanca and did not have good results. At the moment we are in AP. We not exactly feeling rather patient right now... and we're thinking about going with our other plan at the moment. We do not want to sit around on our behinds and 'wait' for an approval that we have no idea 'when' it will ever come. So... In March our plan is for me to go there, we're getting married, then I will come back and file for a CR1. Now obviously cant do that unless the K1 is canceled. But Im not sure how soon I should do that, or how long that will take. Was wondering if waiting until the end of January to cancel would be too late or plenty of time. And how do I do that, do I just write a letter? Send a form?

I fail to see how this would work... CR1 will likely get AP too just like your K1 did.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Agreed... I understand the frustration and wanting to be together... However if there was something (perhaps a name check or other hit) that caused AP for the K1... It will most probably get caught at the CR1, especially givin that the CR1 is an immigrant visa that directly gives the GC upon entry with no AOS...

I would re-think this plan as it is my opinion that as frustrating as this is, there is no "short cut" out of AP... The same things that flagged it now, will flag it then too... Sorry. I say stay the course and let the AP get cleared then you will be here, together and can start out right...

Not name hits just stupid #######... like "your papers are tooo organized... UR FAKE" Nothing out of the ordinary and the whole thing really should have been smooth, atleast I think. Seemed first thing as he steped up to talked to her, she repeatedly called him fake because stupid #######... and even refused our proof which we had tons of.

We thought about doing this, because we have heard of quite a few people that fail at receiving a K1, but turn around and do a CR1 and get approved.

My fiance also had a very terrible interview. He was interviewd by 6 officers, but I am waiting to submit what they need and hopefully by that time I will be out of AP. Or my last resort is going to be DCF. Yes, just wait it out and your AP may not be too long. Just keep follwing up with DOS. At least they informed your fiance that he is in AP. They never told us anything until DOS told me. :(.

If he/she was denied the reasons for denial won't go away by getting married especially if you are a woman and older than your fiancee.

If the petition is/was sent back to USCIS you send a notarized letter cancelling the petition.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

I dont think I can sit around for the next six months or more and wait and wait... already I pester them and send daily emails to the embassy asking about the status of our case. I just cant sit around for 6 months waiting and nothing happening... so we thought we'll give it 2 months, then we'll get married and do cr1. If that fails then I will move there and 7 months later do a dcf. One #### way or another we will be together... him here or me there!

It just really peeves me to no end that we waited for soo long for this interview and we get someone who hates the world evidently, and in every other sentence points her skinny little finger and scream "FAKKEEE"... she doesnt even know anything because she has not even bothered to look at the proof that we gave her. Who in there right mind can make a sound decision if they have not even seen any proof. I hope you two get to be together soon. This is certainly another kind of hell isnt it?

Wait until they tell you that your paper is being sent back to USCIS, and don't cancel your K1. Go and get married file a CR1 and let them know that you had file a K1. Send in a copy of the receipt from your K1 because you are not hiding anything, but you won't cancel it because that will mean you agread with what the CO had to say. Let them cancel it. I never cancel mine and my CR1 went through with everything within 4mos and my hubby home. Most people will tell you to speak with a popular Attorney on this site and some other ones. But let me warn you had i listen to him my husband would not be home with me to this day. So if you like Private message me.

I realise they things that they may see as flags may not go away... BUT... what about the other ppl who get denied k1's and then turn around and get approved for a cr1? He could also very well possibly get another interviewer too? :unsure:

Im just worried at how long it will take for them to respond to this. Approve it or deny it but dang it do something. I have heard ppl waiting months to years to get an answer and never getting out of AP. I thought of sending a letter with my cancelation of the k1 stating why I am canceling it. That we do not want to wait to get married, that we do 'not' agree with the interview that he had, etc etc. I know Im getting ahead of things, its only been a week since the interview. But I cant finction like this everyday not having a plan. If I dont have a plan, I just cant get up in the morning. But sitting around like this every day waiting on them will kill me.

I agree with you. They did the same with my fiance and did not take all his documents. But, luckily they took all our emails and read everything. Still they asked for additional evidence. I am doing the same thing I am in contact with the embassy on a regular basis, but never get any response. Today I am going to stay up and call them. But, the CR-1 route sounds good as the option. I am going to submit what they want and if they take any longer then I am going to do CR-1 or DCF as my last resort. Don't worry there is always away as I am in the same boat with you. I completely agree with you.

Exactly right sister Inky. The CR-1 will very, very likely put in AP as well.

Not the wisest idea to cancel a K-1 because it's on AP, when AP is pretty much a daily occurrence in MENA consulates.

As you are going to go and get married in March. Just wait it out and who knows by that time you will hear some news. Just stay patient AP could only take two months as well. Don't cancel your K-1 just yet, because who knows it might go through. In the meantime just extend your petition so it does not expire. By the time March comes around and you don't hear anything then just get married, but let USCIS cancel it for you.
