Removal and Divorce ,am i ok??

hey guys

i never thought i would post in this section but bad luck catched me:-(

so my situation looks like that

i got my conditional greencard in march 2009...in begin of summer my husband turned to be a completly a***hole

he drunk to much he was lying all the time and in the end he attacked me physical...

my mom in law helped me to find another place so i moved out end of august..iam a state employe have a job

and get along pretty well...

i hoped the last month that my husband will change and will try to make a rehab and see a shrink but he didnt..he put all the blame on me

and iam the one who screwed the marriage up...so i guess there is no chance of getting back together..he is not even talking to me anymore..

so i filed for divorce and will be divorced at begin of january...

i wanna file I751 then...

so iam thinking about the evidence now..i can not file the abuse waiver because i have no police reports..he attacked me twice and threatend to

me if i call police he will kill me and i was to affraid...

so i plan to file the regular 751 with check the box marriage entered in good faith but failed..

the thing is i dont have really a lot evidence

at the interview we brought some pics ( 10)

and join bank accounts,car incurense

and 1 affidavit...

we didnt have any kind of ultilitie bills or rent contracts because he parents are paying everyhting

so thats what i have

copies of the join bank account

car incurence with both names

vet bills and farrier bills in both names

letters on both of us

affidavits from friends who are confirm what he did

also affidavit from mom in law

and i wanna write a statement by myself and tell my side of the story

and i hope that the fact that i work for the state helps me too...

so u think iam ok??

to file with a waiver on bonafide marriage, you need a divorce decree.

if you don't have a divorce decree, then you have to prove abuse and file under the abuse waiver situation

<so iam thinking about the evidence now..i can not file the abuse waiver because i have no police reports>

tough luck; you have to prove somehow the abuse ...

otherwise, file jointly ... but if he doesn't cooperate in case the USCIS calls for an interview... you are up the creek

Uh, now I see that you will get a divorce decree ... sorry I overlooked your entire statement.

You will be fine with all that evidence that you were married "for real" .

Being a state employee will mean nothing to USCIS. But you could provide a brief written affidavit from your mother in law about the facts of the marriage as she knows them.

thats why i wrote that i have to file the usual 751 because i dont have any police reports...

@old dominion...mh i disagree...i am an officer of the state of texas...i guess that means a lot more as i work at the check out at any store...

and i will provide a statement from my mom in law i allready wrote that....

the question is if the evidence i have will be enough...?!?!?!?!?

You will be surprised that very recently a reputed AILIA lawyer was accused of Immigration fraud. Officers or Janitors; all are treated equally. An honest Check Out store person is better than a crooked officer of the State.

No disrespect, but equality exists.

You should have left your Beamtenmentalität right behind you in Germany. A change of attitude might be in order. An "officer of the state of Texas?" Ooooooh, we're all soooo impressed. Except not really. Semi-literate LaSkaneesha at the DMV is an "officer of the state of Texas". "I'm employed by the state and the rules don't apply to me" does not fly here. You're in a different country now, and the sooner you'll realize that, the better.

Hi Goldfee. Guys, treat her nicely. I remember her from AOS, and she is a nice person.

She was probably asking the "I work for the government" question because we get really nervous when the US citizens changes after marriage and we are left in the dark... It's not easy, I know how she feels. We try to imagine what might help us prove that we are honest people.

Anyway, it is not true that you need a divorce decree in hands these days to file for a I-751 waiver. A blessed USCIS officer realized it was not fair for those left on a limbo between separation and divorce decree and released a new amendment in March (check my signature). You can file even if you are only separated.

Goldfee, all you really have to prove is the bonafide intention at the TIME of MARRIAGE. The proof from after being married time will add to that, but if you can prove that you were in good faith in the time you got married you should be fine. Try to gather as much evidence as you can and put it in a safe place.

Good luck and let us know how it goes. I am in the same situation, unfortunately.

Goldfree, please post only in English in these forums. The regional forums are the place to post in your mother tongue. :)

As for your employment making any difference in your removal of conditions proceedings, I'm sorry to say it does not, at least not in the way you're thinking. That you're employed is a good thing because it proves that you're not a public charge, but being a state employee has no bearing whatsoever on the decision to grant the removal of conditions on your greencard. Being able to prove that your marriage was entered into in good faith is what will be the deciding factor. Regardless of what your USCIS friend told you...there is no official policy of law that states that 'state employees' have a better chance than the average store clerk.

It sounds like you have good evidence of a bona-fide marriage. Your affidavit letters should focus on stating that...not so much on the abuse. Remember, you cannot prove the abuse, and you're not applying based on that...so your letters from friends should concentrate on telling USCIS that they attest to the bona-fide nature of your marriage, while it lasted. Given that you will have a divorce decree at the time of filing, and you will be filing that the marriage was entered in good faith..it just ended, you will ONLY need to prove the above. Good luck.

The reason I'm saying NOT to focus on any physical attacks your ex-husband may have committed against you is because you haven't got proof (police reports, etc.) of the attack and it may confuse the situation. Any mention by your friends of a physical attack by your ex constitutes hearsay. You may mention it in your letter that you plan to write...but unless your friends were physically present when he attacked you, their mention of the attack is meaningless without any corroborating evidence.
