Do not know where to start but if I left the USA before I got my AOS/EAD what would be the consequences? Things have gone a little haywire and I need to know my options.

it would be consider abanding your AOS and it will be denied. You can apply for Advance parole that way you can reenter the USA during the AOS process.

As far as I know, like the previous post stated, you`d most likely just abandon your application. Other than that, I don`t think there are any other consequences. If you ever apply again , you might just have to explain the circumstances as to why you left and abondoned your previous application etc....

You will still be allowed to re-enter the USA, if you ever want to visit and won`t be barred , but you might need a visa to do so, like a tourist visa.

Oct 10 ,2006 Received fee bill from NVC

Nov 13 ,2006 Received Packet 2 DS-230

Jan 4, 2007 Mailed Packet 2 to NVC

Jan 22, 2007 RFE from NVC aaarrrrgggghhh!!!!!!!!

Feb 28, 2007 NVC received "checklist" response and original documents for the RFE

March 13, 2007 Case completed at NVC! Whoooohoooo!! Ankara, here we come!!!!

March 15, 2007 Case fowarded to Ankara Embassy

April 4, 2007 Interview. Wife gets handed the little green paper. Not good. Need to submit a few more things.

April 9, 2007 Items mailed back to Embassy. Crossing fingers, rubbing the "rabbit's foot", etc,..that this may FINALLY be the end.

April 14, 2007 Visa delivered! Wife is finally going to be on her way back home!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

April 20, 2007 Wife enters through JFK. The days of grabbing my dinners at the WalMart deli....are now officially over!!!

Either apply for the Advance parole before you leave - DO NOT LEAVE WITHOUT IT! if you do leave without it - and are already married - you will probably have to file for the k3 again - and that would still be another wait for you outside of USA. That happened to another member that I have been in contact with - he had to come back to UK adfter his marriage for a family emergency and was nto allowed to go back to USA even on vwp they had to apply for the K3.

The document you need to leave is Advanced Parole (which is, in a sense, wound in with the AOS). You don't have to apply for EAD at all if you don't want to, and it has no bearing on you leaving the US.

But if you leave without AP, you will have to start over again.

You can get emergency AP if someone in your family is sick (govols had to get this for her hubby). I'd much rather do that than start all over.

You can try. But now you have to do it by InfoPass. And it's not much good to try to get AP by InfoPass if you need to be home right away. The soonest appointment my husband could get was four weeks away. So if someone is terminally ill and has less than a week to live, then you're SOL trying to get emergency AP. Maybe there are some offices that still do walk-ins, I don't know. Newark does not (and you can only do it through your local DO).

That was why I specifically mentioned govols (Karen). If I remember right, her hubby had an illness in his family and was able to go to Memphis and get emergency AP. But I don't remember if they had to wait a while to get an Infopass appointment or not. Janice, maybe you could PM Karen and ask her.

If you have already left, then you will now prolly have to file the I-130 & if you want to the K3(optional)!!

Thanks alot for the replys..

I am very home sick and lonely also I am having trouble with a certain member of Jon's family, I am also having trouble with my eldest daughter so being bashed on two corners is just overwelming. I do try to stay out of the way, I do not go out, I rearly go out of this room. I am not used to living with other so called adults and getting treated like a child. I actually did not do the washing up yesterday for the first time in five months and guess what it is still there :(

Janice, see if you can make an INFOPASS appointment and get AP before you leave. Otherwise you may be stuck back in England waiting on a K3 or CR1 visa, which will take about a year.

I can relate with the desperate homesickness believe me, but before you go, weigh the pros and cons.
