Sorry, Casper, getting the RFE sooooooo delayed is confusing and you are both having trouble even knowing why. Alas, I suspect we are on the same path, but I have now written my Senator, and if nothing else, it may get our application moving from collecting dust on some desk!!! I have emailed Ivan the form they will likely want, to sign and return, suspecting California will ask for it and he needs his personal John Hancock on it. Since he was turned around at a POE last September (for the Department of Homeland Security knowing he accepted unauthorized employment while here on a tourist Visa in 2007), and we have two more years to go before he is allowed readmission (unless we cough up $545 extra and an I-212). We are readying for a longer and more costly path to a Fiance Visa in requesting an early absolution.

Chin up to every VJ filer, as we have found the person of our dreams, and we will handle what comes and keep our eyes on the horizon. Even the wait is not as bad when it is for the one you love. I have faith everyone´s time will come...

6/30/2010 Consulates list of "cases ready to interview"

7/5/2010 "call back in 8 wks and THEN we will set interview date"

July 2010 Three MORE calls-"now I can't book end of August, that's too far ahead to put on the calendar".

August 2010 Last-minute decision by two of Ivan's boys that they want the K2, two more weeks of drafting and Notorizing new legal custody agreements

8/12/10 A FIFTH PIN and call-- "call back just ahead".

8/16/10 A SIXTH PIN and call-- "we can book you for in two days, but if you want next Monday the 23rd or Tuesday the 24th, then call back later THIS WEEK, and we will book you for MONDAY MORNING". frustrated letter by me to Consulate email

8/17/10 Call from US Consulate Guayaquil, man profusely apologizing, books us for 24th.

8/24/10 K1 interview--denied--told he has a lifetime ban. Sad, sad, very sad day.

Currently investigating options on marriage...then 1.5 years of more wait.

Casper- how did you know you have a RFE? was it just the person on the phone that told you that?

Hey AJ, When I got the NOA 1 I went immediately to the USCIS website to check my status: https://egov.uscis.gov/cris/Dashboard.do

In the middle of the screen you will see:

You can register for automatic case status updates by email and text message by creating an account.

'creating an account' is a hot link. If you click it you can sign up for email or text notifications of changes in your status. I chose email and that is how I got the notice Friday morning that the RFE had been mailed the previous day.

The people on the phone were the ones I contacted after getting the RFE notice to try and get more information faster than waiting for the snail mail to show up.

Hey Casper

That is real lame news about the RFE.

The plus side to all of it though is you know they looked at your case and from what I have seen on time lines it doesn't take long at all after you mail your response back to get approval!

You will have to let us all know what the heck the RFE was about since you said you basically had everything put together with your petition.

I was asked a few questions and spent my time waiting talking to another lady who is married to the USC. They hired an Immigration Lawyer and she said they have given them nothing but grief & lots of misinformation. I told her about all you amazing people here on VJ and she said she had heard of this site but never came here.

I was asked:

Q. How did you meet?

A. We met in Second Life.

Q. Whats that?

A. An online game.

Q. When are you planning on travelling?

A. We are hoping for this weekend.

Q. What does he do for work?

A. He is a Windows System Administrator/Infastructure Analyst or I affectionately call him the IT Geek. (she laughed)

Q. How do you keep in touch?

A. We keep in touch via phone,email, msn, Skype whichever web cam program works best on the day really.

Q. DO you have any proof of the relationship?

A. (holding lime green folder full of it!) I said yes would you like to see the chat logs or the emails? She replied 'No its ok I found the photos and they are better'

Q. (She asked Rebekkah my daughter) Is that your brother?

A. Yes it is.

Q. Did he not want to go with you?

A. No he wanted to complete Years 11 & 12.

'Love the photos around Sydney...who took them?'

Oh a friend of mine who is from Seattle. We flew her in from Brisbane for the day to take our engagement photos.

'Ok everything is in order, your visa is approved. We will print out your visa & have everything mailed out to you in the satchel in the next 2-3 days. The yellow envelope you are not to open it, but keep it with you in your carry on and hand it over at the airport you come in to.'

I keep checking to see if they are doing anymore December filers. What the hell is up with all these February filers gettin approved!?

Jeeze guys I am real sorry I know the wait must be harsh.

I hope you get your RFE soon Casper so you can get it the heck back there and get that awesome approval and do the approval dance!

One bit of good news! I got the RFE today. Finally. It took me 15 minutes to open it worrying about how ugly the "request" was going to be. When I did open it, there was only one item: 'We need proof that you have met in the last 2 years.' You gotta be kidding me?! What about the afidavit and countless photos in multiple countries??? Apparently, and this just shows what century the USCIS is living in, "...only film dated photos count..." Ok, when was the last time someone used film?!

So, now it's 9pm, I'm at the office making color copies of my passport showing Ukraine Visas, copies of airplane boarding passes, blah blah. I send it back in the morning and with a little luck get my NOA 2 in a couple weeks.

Photos are secondary evidence that is used to support primary evidence: boarding passes, passport stamps.

We saw and forecasted similar RFE's in VSC December thread

No, Terri, that was not the reason. They understand that in this day and age digital photos do not have date stamps (you just write where and when it was taken).

Thing is, you can include 1000 of photos and no boarding pass - and they will send an RFE.

Photos are easy to forge, thus it's a secondary supporting evidence. Not just for I-129F, for all stages. AOS, ROC, whatever.

BUT! Photos in conjunction with primary evidence is a very good combo.
