I know this information is here somewhere.. put can't seem to find it.

We've just received an interview date of February 23rd, but our petition expires on Febraury 19th. How do I apply for an extention?

02/23/08 - Met in Turkey
07/09/08 - Denial of Visitor Visa to U.S.A.
06/04/09 - 2nd Denial of Visitor Visa to U.S.A.

09/22/09 - I-129F Sent
09/24/2009 - NOA1
10/19/2009 - NOA2

INTERVIEW DATE - February 23, 2010 - also the two year anniversary of the day we met smile.png

03/30/2010 - Married

04/29/2010 - Mailed AOS Packet
07/14/2010 - AOS Approved!
07/24/2010 - Green Card in Hand!

04/26/2012 - Mailed ROC Packet
01/03/2012- ROC Approved

01/10/2013 - 10 year Green Card in Hand

04/14/2102 - Mailed N400 Packet

05/13/2013 - Biometrics
08/19/2013 - Citizenship interview

09/18/2013 - Oath Cermony.

The Consulate will extend any 'expiration date' . From your perspective, it will 'seem automatic'. From the Consulate's Perspective, it's a simple admin task to do.

No Need to fuss.

Not quite. You need to submit a request to extend approval to the embassy. You can find an example letter in the example forms:

We submitted one last month to our embassy without any problems.

It all depends on the consulate; for example, it is automatic in the UK...not so in every country. I suggest you ask in the regional forums and do a search. Good luck!

Basically what the Polish consulate asked of us was to bring this letter to the interview. We had already mailed it before they made that request, but, I would suggest you make up one of these and bring it with you... if you don't need it, great, but if you do, you will be prepared :)

Your NOA2 does not have to be extended since you have received an appointment date before that expiration. The same thing happened to us and I called the DOS and that is the info they gave me.

Hi,

I have already sent my initial I-129 application and received the NOA1 fairly quickly. I am still looking for work. If I need more time to get the work/financial situation improved before I send in the Afficavit of support, what is the expected time on that and can that be extended if need be. I don't want to have to apply a second time say next year some time.

- 2008 Dec 2-7 Met 1st time in person (England)

- 2009 Mar 28 Became engaged

- 2009 Apr 2-15 Met 2nd time in person (Syracuse-NY-USA)

- 2009 Aug 25 - Sep 25 Met 3rd time in person (Syracuse-NY-USA)

- 2009 Oct 19 Sent I-129F Application to USCIS

- 2009 Oct 30 NOA1 received

- 2010 Jan 20 NOA2 received (Approval Notice)

- 2010 Feb 4 Notified that approved I-129F petition forward to US Emabassy at London

- 2010 Mar 26 - Apr 15 Met 4th time in person (Fairfax-VA-USA)

- 2010 July 29 Fiancee had medical in London

- 2010 July 30 London Embassy Interview Date (K1 Visa approved pending a laundry list of medial stuff)

- 2010 Nov 2 Courier website shows K1 Visa packet enroute for delivery. 1st indication of final approval!

- 2010 Nov 3 K1 Visa packet delivered by courier! Visa's are in the building and in my fiancees hands! (tentative Jan 2011 arrival)

Hey Jenn, I had emailed Ankara on this very topic while awaiting our interview earlier this year and they said they automatically extend it and it was, as we had passed our date!

I emailed them also, but like my other emails to them I have not received a response. I called DOS and they said I didn't have to do anything.. I figure if I send the letter, just to be safe, it can't hurt.. Worst case is they would have one more piece of paper they don't need.

You won't need the Affidavit of support unti you have NOA2 and your case gets sent to the consulate. Then you have four months on the NOA2 that you can wait on to send in packet # 3 with the Affidavit. You can extend that in four month increments if you need to.

K-1, right ?

your foreign fiance has a couple of things that CAN be done, to delay an interview date:

1 . NOT return P3 documents immediately, wait a few months and

2. when send in P3 documents, ASK for 'later' appointment date , in a cover letter.

The I-134 (affadavit of support ) is PRESENTED on INTERVIEW DAY, so - you need to think about ways to extend the interview date.

But hey - dig around here at VJ - you'll see some folk with the same , or nearly same, scenario, with a need to delay a bit.. Reasons for delay varied (sick mother, school term, etc ) ..

If you need more time beyond the expiration date stamped on the NOA2 (when you recieve it, which will be some time yet), you should send in the request for extension mentioned above to the embassy. It gives you 4 additional months from the expiration date, however, I believe additional extensions can be requested, each for 4 months up to 1 year, but that could be wrong.

Your fiancee does not need to hold off on returning the packet docs to the embassy. Instead, send the requested documents (which do not include the I-134), then have her call the embassy and request to have the interview delayed AND you send the extension request letter.

That's what I did for the Polish embassy.
