hello,

I just want to ask here if someone who knows and have case like me. My concern is my husband passed away already,we got married here in the phil. and unfortunately im still here in the phil. waiting for the processing of our CR1 but while we are on going of our papers he passed away in US he was a american.he died at age of 45 due to heart attack.he had a social security number. I just want to know if im able to get a pension which is the survival benefits of my husband from his SSA?because he is just 45. Is there any survival benefits/pension i can get for me as the widow? Hope someone here can advise me and help what should i do and Give some information.

If your husband dies, you can get widow’s benefits if you are age 60 or older. If you are disabled, you can get widow’s benefits as early as age 50. Your benefit amount will depend on your age and on the amount your deceased husband was entitled to when he died. If he was receiving reduced benefits, your survivor benefit will be based on that amount.

If you are a widow with children, you may be eligible for a widow’s benefit at any age when you are caring for a child who is younger than 16 or disabled and entitled to benefits. As a widow, you also may be eligible for Medicare at age 65.

If you remarry before you reach age 60 (or age 50 if disabled), you cannot receive widow’s benefits as long as that marriage remains in effect. If you remarry after you reach age 60 (or age 50 if disabled), you will continue to receive benefits on your deceased husband’s Social Security record. However, if your current husband is a Social Security beneficiary, you should apply for a wife’s benefit on his record if it would be larger than your widow’s benefit. You cannot get both.

If you are also entitled to retirement benefits based on your own work, you have some other options. Ask a Social Security representative to explain the options, so you can decide which would be best for you.

To receive a survivor benefit while in the Philippines and be a citizen of the Philippines, you need to have been married at least 9 months and have lived in the U.S. as husband and wife for at least 5 years.

If you can make it to the U.S. and remain unmarried, you can receive a widow's benefit if you are found to be disabled within 84 months of his death and are at least age 50 or you can receive a widow's benefit when you reach age 60. However, if you leave the U.S. and are not a U.S. citizen the benefit will stop after 6 months and the benefit cannot start until you come back the U.S. for at least a month.

I didn't realize until today that SS rules in the US are tough for widow(er)s compared to the Philippines. In the Philippines, as soon as the spouse dies, the surviving spouse (regardless of age) and dependent children get either a lump sum or monthly pension right away. The amount of pension isn't that much but it helps with day-to-day expenses.

I didn't realize until today that SS rules in the US are tough for widow(er)s compared to the Philippines. In the Philippines, as soon as the spouse dies, the surviving spouse (regardless of age) and dependent children get either a lump sum or monthly pension right away. The amount of pension isn't that much but it helps with day-to-day expenses.

Well if there are children under age 16 or disabled the widow can receive a benefit at any age. Children can received benefits until age 18, they graduate high school, age 19 in still in high school or until they die if disabled.

There is also a $255 lump sum death payment that goes to the spouse living with deceased spouse at the time of death or to minor children.

I didn't go into all that since there was no mention of children and they weren't living together when he died.

thanks for all the response. It help me so much this all information. We just married less than a year and unfortunately we dont have yet any children. Im just thinking maybe im not able to get SSA benefits of widow as survival benefits cause from what the written above im not qualified because my age im not yet reach on that age level nor have a disable or child.

I am interested to know if you did try to apply for tourist visa for humanitarian reasons with the US Embassy to see your husband for the last time.

thanks. I called the lawyer who hold our papers in our CR1 processing and he told me he already talked to my mother-in-law ,he said they are trying to find way to my papers to be fast and can attend the funeral service by next year of MAY by spring or summer time. Because for now my husband ash was place at her mom house.Probably thats the only way i can come to US just for the last time i can show my presence.

For now my mother in law doesnt focus yet with my papers because he still sort out all things my husband left like with his all assest.

thank you so much pinay wife. yes i will cause i dont have no choice im trying to be strong and continue living without him eventhou its hurt
