I-134 affidavit of support question, is this ok????

Hey guys, me and my fiance are so excited to be starting this process!!! We just got our NOA1 last weekend and I know I have time but I would like to start preparing for the rest of our journey. I m starting to be a little worried about the I-134. I am a waiter and most of my money is made in tips but I have been making an average each month that puts me around $21,000 a year. I know its over the minimum, but my tips are under the table and I plan on reporting them anyway at tax time. I also have no one I can think of who would sponsor us. I guess my question is will they be less likely to think I can support her because of the nature of my job and working off of tips? Also, I started my job in August, so can the length I have had my job be a problem? Im suppose to be moving up in position to a manager soon so hopefully that will happen before I even have to send the I134 in. Thanks for any advice you can give me!

Consular officers are trained to consider the totality of circumstances on these issues. If you do get promoted to a salaried position and can show pay stubs and an employer letter, you will probably be ok but you current situation is weak.

Having been self-employed and semi-retired I had no W-2's or 1099's to show but did pay more taxes than I owed the last 3 years. Just to be safe. As turns out I did not need to. I just could not use all the deductions. It helped to have some savings to show.

If you plan on reporting your tips, then how and why would they be "under thr the table"? There is no law against getting paid cash. Why can't your tips be reported to the business and included in your income? Then it could be verified by your employer. If the income is unreported, cash, and unverifiable, then it does not exist in the eyes of the USCIS.

I would either start reporting those tips to your employer and/or deposit all of them in the bank so you get SOME "paper trail" to show an income. If you plan to pay tax on them anyway, better to start witholding now. USCIS uses your gross income, so withholding will not hurt you on the I-134. Otherwise, line up a co-sponsor. No money, no honey.
