Hi,

we are doing the DCF in Montreal.

We have just done the 1st step last week at the US consulate in Montreal. And the immigration agent told us that our biggest challenge will be to prove domicile in the US for the interview.

a quick sum up of our situation:

- my husband is canadian and us citizen

- i am french and permanent resident in Canada

- we both live in Montreal

- he has his american aunt in Chicago and his american-canadian parents in Canada

- my husband and I are working in Montreal but we would like to live in New-York

How could we prove domicile in the US considering all that? What are the different solutions if there are?

please give us your feedback and experience :-)

He would first need to establish a residence in the U.S., a legal address, and I assume also a record of mail going there, paying taxes in the US, etc. Otherwise, you are domiciled in Canada. Assuming that is impossible, then you need to try another approach.

Hi Pucca and welcome!

This thread will probably help you:

Proving domicile when not living in the U.S., Even if you have never lived in the U.S.

Also, ensure your Husband has filed U.S. taxes for the last 3 years.

Keep in mind that you are not trying to prove 'domicile' per se - you are going to prove intent to 'reestablish domicile no later than the intending immigrant' that will get you started, let us know if you have more questions!
