Hi everyone,

We are ready to send in our AOS package and although I know that everything except the Affidavit of Support is to be filled out by my husband, it seems that lots of people have written cover letters on behalf of their spouse. Would it be a problem if it comes from him or do they expect it to come from the petitioner? This is the format of our letter:

Nature of the submission: Immediate Relative (Spouse) Family Based Adjustment of Status Application

To whom it may concern,

Enclosed please find my Forms I-485, I-765, and I-131 for adjustment of status, my application for work authorization, and my application for advance parole, and all supporting documents.

Contents include:

- Payment in the amount of $1,010.00 (Check)

- Form I-485

- Copy of my passport (biographical pages and entry stamps)

- Copy of K-1 Visa from passport

- Copy of NOA2 "Approval" for I-129FForm G-325A

- Valid I-94 from passport (Front and Back copies)

- Copy of my birth certificate (translated)

- Certified copy of our marriage certificate

- Two passport-style photos in plastic bag

- Form G-325A (4 Pages)

- Form I-693 (sealed in an envelope by a U.S. civil surgeon)

- Form I-864 Affidavit of Support with the following supporting evidence provided by Vicki (petitioner):

o Copy of most recent tax return (2008) and supporting W-2

o Copies of pay stubs for the most recent six months

o Employment letter

- Form I-765 Application for Employment Authorization with the following supporting evidence:

o Photographs (2) of immigrant (passport type)

o Photocopy of passport biographical page and K1 visa page

o Photocopy of Form I-94 Arrival/Departure record

- Form I-131 Application for Travel Document (Advance Parole) with the following supporting evidence:

o Form I-131 Supplement, Part 7 - Statement of circumstances that warrant issuance of advance parole

o Two passport-style photos

o Photocopy of passport biographical page and K1 visa page

o Photocopy of Form I-94 Arrival/Departure record

you are the USC spouse; Jan is your foreign hubby, correct?

I'm a big fan of cover letters, and yours is very nice, indeed.

What I would suggest is that you both are joint authors of the cover letter, although strictly speaking the US citizen applies for Adjustment of Status for her foreign husband, not vise versa. Hence, I suggest modifying some parts as follows:

1) Use lower case letters for "front and back copies" in order to maintain consistency

2) Change:

Copy of my birth certificate (translated)

to

Copy of beneficiary's birth certificate (translated)

3) Form I-765 Application for Employment Authorization with the following supporting evidence:

Put a comma after "following"

4) Photocopy of passport biographical page and K1 visa page

Change to passport's . . . (the pages are possessives of the passport)

5) You have listed the passport-style photos twice. Lose the plastic bag!

6) You have listed the Form I-94 Arrival/Departure record twice

Very comprehensive, very good.

Should be a home run.

Cover letters are optional. they can be signed by either or both or no one.

Strictly speaking you're incorrect. The petitioner is the one that applies for the Adjustment of Status...the I-485 is the foreign spouse's petition...not vice versa. Hence I suggest the OP modify nothing.
