My fiance just graduated from college this year and has no job at the moment. He is trying to set up a new business, which could take a while. We are approaching our interview date for K1 visa and we don't know how to handle the affidavit of support situation. We deffinitely need a co-sponsor, but is it enough? I mean we know the co-sponsor requirements and we are sure he will be able to follow them (the poverty line and such). My fiance isn't living on welfare or other government benefits. Would it help if he could prove he is just setting up a new business? What exactly should I say at the interview? Anyone in a similar situation? Couldl I be considered a public charge? Im not sure if I was very coherent. Im trying to read as much as possible about it, but every situation seems different.... Thank you!

You likely won't say anything. He needs to submit an I-134 and support information, even if his income was -0-. Then the co-sponsor also submits the same PLUS pr+oof of US citizenship or that he is a permanent resident. Give both to them when they ask for evidence of financial support, they know what a co-sponsor is.

Could you be consuidered a risk to be a public charge...yes. Would you be with a qualified co-sponsor? I doubt it. Is each case different? Yes. Consualtes look at each case individually, they make a subjective decision for each case...behind closed doors. If they do not feel your financial support is sufficient, they will give you a notice your visa is held until you produce more suitable support and will give you time to do this. Unfortuantely there is no "win/lose" point, no "finish line" A person could meet the guidelines and be refused because of a myriad of other reasons...sourc of insome, permanency of income, work history (derived from tax returns though it is sparse at best) The best you can do is the best you can do. If your cos-sponsor meets the requirements, you will most likely be approved

Future plans, promised income, yada, yada, has no effect and is not considered. A self employed person needs substantial documentation of current income and if he is just starting the business he likely will not have it.

Improved USCIS Form G-325A (Biographic Information)

Form field input font changed to allow entry of dates in the specified format and to provide more space for addresses and employment history. This is the 6/12/09 version of the form; the current version is 8/8/11, but previous versions are accepted per the USCIS forms page.

What exactly should I say at the interview?

When asked a question about anything, simply answer truthfully. There's nothing unusual about your case from a financial standpoint. The answers are the same as anybody else needed a cosponsor.

Facts are cheap...knowing how to use them is precious...

I think the key thing is that if your petitioner intends for you to actually obtain a visa, he'll need to find a qualified co-sponsor.

Yes, you're right. It's a key thing. We think his brother qualifies, but we haven't had the chance to go through all the papers yet, due to some health problems in the family :( So, right now I just want his dad to get better.
