I talked to 2 different immigration lawyers on the phone today and each of them told me that I needed to have some ID Documents from my Fiance when I plan to start the K1 process.

They told me I need to have the Fiance's Birth Certificate and all Pages of her Passport to submit with the I129F Petition.

I further explained my situation to the lawyer and said that my Fiance does not yet have a Passport and she is currently applying for a passport. One laywer then said we may receive an RFE (Request for Evidence) due to the fact that the Passport of the Fiance has not yet been created.

I have not seen any mention of such documents required from the fiance on this on the VJ website (I129 Checklist) or on the I129 Instruction sheet - so I just wanted to ask an open-ended question about the advice I received on the consultation from the lawyer !

The beneficiary does not need to provide these documents until later in the process (at the interview), you're correct. Only the petitioner (the USC) needs to show birth cert or passport pages to establish citizenship, as only citizens may petition for a K-1.

K-1:

You will need this from your fiance when you plan to start your K1.

G-325A filled out by the foreign fiance(e) signed and dated. Original

Original statements (from both the US Citizen and foreign fiance) certifying an intent to marry within 90 days of entering the US on a valid K-1. Original

One passport-type photo (see specification) of the foreign fiance(e). Write the full name of the foreign fiance(e) on the back. Place in a plastic bag and label the bag "Photo of (insert foreign fiance(e) name) ". Attach the bag to a sheet of paper and place behind the corresponding G-325a

Copy of final Divorce Decree(s) or Certificate(s) for the US Citizen and/or foreign fiance(e) if either has been previously married. If the previous marriage of the US Citizen and/or foreign fiance(e) ended due to the death of their spouse then include a Copy of Death Certificate(s) documenting that fact.

Proof of Legal Name Change if either the US Citizen and/or foreign fiance(e) is using a name other than that shown on the relevant documents. You must give USCIS copies of the legal documents that made the change, such as a marriage certificate, adoption decree or court order.

In regards to Section C Question 2, if applicable provide certified copies of all court and police records showing the charges and dispositions for any specified conviction(s) (in accordance with the IMBRA). See section 9 of the I-129f instructions for more information

When I applied for the K1 1-129 my fiance did not have a passport. We did include a copy of her birth certifcate and the other requested documents.

The attornys are wrong. Both of them. They are either ignorant or lying to you. You can continue calling attorneys and each one of them that tells you that you neeed her passport or birth certificate for the I-129f filing is wrong. Those documents are NOT needed from the foriegn beneficiary for the petition filing.

From her, you need a fiancee letter if intent, a signed G-325 and copies of any divorce certificates (if applicable) a passport type photo and that is ALL. Read the guides, read the I-129f instructions.

I have responded to many of your questions, all of them very elimentary. This means you have not read the guides and instructions or do not understand them. In order for you to be sucessuful you will need to do this or pay someone to do it for you. Trying to successfully complete a visa proicess by calling multiple attorneys that have no interest in giving you correct answers unless you pay them, will not work.
