I alwayse thought K3 is considered a non-immigrant visa, but when I looked at the NOA2 for it, it says on there to file AOS upon entry to USA.

Does the US gov consider a K3 an immigrant visa now?? I don't want a situation in the interview where i go in there assuming its a immigrant visa and the consulate officer says you can't immigrate with a K3 and deny it like a tourist visa..

K-3 is a non-immigrant visa because it does not confer residence to the beneficiary. Once in the U.S., the K-3 beneficiary has to file a new petition to adjust status for residence.

Nevertheless, you'll find the Consulates' Immigrant Visa Units process the K3 visa.

For the most part though, I consider the K3 visa virtually obsolete and a waste of time and money. :thumbs::thumbs:

Facts are cheap...knowing how to use them is precious...
