Hi All!

Here's my question. I am a US citizen and my Russian fiance and I are filing an I-129F.

I am having a difficulty with question 11: Have you ever filed for this or any other alien fiance? The situation is, several years ago I filed I-485 (Application to Register Permanent Residence or Adjust Status) for my now ex-wife. As a result she received her green card.

Question: Do I need to put that information (my ex's A# and date/place of issuance) here or does this question refer ONLY to any previous I-129F petitions?

The way I read that question, it applies to previous I-129F applications. So the answer would be no. To be safe you might want to include a supplemental sheet for question 11 and explain that you previously filed for an I-485 and the A#. GL

The way I read that question, it applies to previous I-129F applications. So the answer would be no. To be safe you might want to include a supplemental sheet for question 11 and explain that you previously filed for an I-485 and the A#. GL

Greg001, thank you, your reading makes perfect sense to me. However, and this complicates things somewhat, I do not know my ex's A# is and have no way of contacting her either. Would simply mentioning that I had once filed for an I-485 and stating something like "more info available upon request" be sufficient enough to be put on the supplemental sheet to the I-129F application?

Actually, your ex-wife was the one that filed for the I-485 (I assume from other than a K1 visa status). So if anything, you might just state that an ex-wife applied and was granted permanent resident status in 200x.

And... at the time of the I-485, she was not a fiancee. Just answer no. Don't make a complication where there is none.

Gary and Alla, I appreciate the explanation very much. As always there is more to the picture though. If I may:

1. Question 11 does state "Have you ever filed for this or any other alien fiance or husband/WIFE before" and my ex was indeed my wife at the time of I-485 submittal.

2. I believe (and my memory may fail me on this one) that along with I-485 we filed I-130(Petition for Alien Relative), at least it would make sense for us to have filed it the way the adjustment process is set up.

Does that change things?

Yes, that changes things.

Your ex-wife filed I-485, but you had to file an I-130 Petition for Alien Relative to provide a basis upon which she could adjust status. So yes, you have filed for an alien wife before, so the answer to #11 on the I-129F is YES. If you don't know her alien number, put "Unknown" as previously stated. Just provide as much information as you can about your ex and the "result" (i.e., petition approved, adjustment of status approved, etc.), using a supplemental sheet if necessary.

Improved USCIS Form G-325A (Biographic Information)

Form field input font changed to allow entry of dates in the specified format and to provide more space for addresses and employment history. This is the 6/12/09 version of the form; the current version is 8/8/11, but previous versions are accepted per the USCIS forms page.
