Hello everyone I am new here. I live in England UK and I am a British citizen, my fiancee is a US citizen and lives in California. We have applied for the K1 visa for me to go and marry her and live in the US. We didn't use a lawyer or anyone, I just researched it on the website ( which is the best on the web in my opinion) and we sent it off in April this year. The petition has now been approved and we are waiting for the next part.

We have known each other since Jan 2007 and I have been to visit her many time since then. My question is about her coming to visit me. She tried to come here last year but was denied entry mainly due to not having a return ticket. She wants to try again but we are both worried that if she is denied again, could it affect our visa application?

We don't think she will be denied again as we have learned a very valuable lesson but realise it could happen and both agree that we could handle the denial, but what if it messes up our visa application.

Hopefully, I will hear something from the embassy in London fairly soon, but my family have never met my fiancee and she would love to come here before I leave here. My family are coming for the wedding but they would like to meet her at least once before then.

If you have received the NOA2, you can contact the Department of State to see if the packet 3 has been sent to her. If it has, she does not have to wait for it to arrive. She can go ahead and start getting everything ready to go and there is a lot that needs to be done at this stage, booking the medical, forms to be filled out, police certificate to order, etc.... I have a lot of information that I can send you that I got here off of VJ through research. If you are already this far in the process, then you don't have much longer to wait til she can come to the states...

Another suggestion is that once you have the interview date scheduled, she could come around that time and go with you to the interview and at the same time meet your family...

She is already in the USA, she lives there. I am the UK citizen waiting for my visa.

Thank you for your reply, it is very helpful and maybe I should start looking at getting my medical and police reports etc.. but I still would like to know if her being denied entry to the UK could affect the visa application...

Since you are applying to come to the US and have not been refused entry, there should be no problems. The US is not going to care about her refused entry into the UK. At this rate, if you get all of your stuff done quickly, you could have an interview set in the next 6 to 8 weeks...and she can come and join you... If you need any information at all about the packet 3, links to the embassy, checklist, police certificate, etc...let me know and I will be more than happy to send it to you..

Thanks! So she can come and visit me whenever she wants while we wait for my interview? It won't affect the visa at all, if she gets denied entry? i didn't know she could come with me to the interview.....that's an idea.

The US citizen/fiance can visit the UK with no affect on your visa - even in the event she gets denied entry (which I can't imagine why that would be the case), there would be no affect on your visa process in any way. :thumbs:

So my fiancee can definitely come and visit me and come to the interview with me?

The US citizen fiance/spouse can attend the interview. (Some Embassies/Consulates vary on this, but I believe London does - at least that is what is currently posted in the Embassy Section.)

Yeah she can. Check out our UK forum at the bottom of the main forum page; we have a a 32 page thread about people in the UK between NOA2 and the interview process and it has a ton of helpful information.

No problems as far as issuance of a K-1 visa. Now if she wanted to move to England that may be a problem.

...and there's no reason why she should be denied entry, provided she has a return ticket and can show some sort of evidence that there is a life to go back to in the US - like something from her employer showing she's expected back on a certain date.

Shouldn't be any problem with entry if your fiancee brings her NOA2 and proof of intent to return to the US. Basically, why would she be intending to immigrate with you being almost through the US entry qualification? Can't imagine they'd turn her away under those circumstances.

Customs can be asshats at times. My Active Duty military husband (then fiance) was held back in Customs, despite having a leave approval document from the Army proving he had to return on X date. (Admittedly, Norwich International Hahahahah isn't used to too many Americans travelling through it, being a teeny regional airport).

If there are any queries, just tell your lady to be calm and rationalise it for the "nice" Customs Officer.
