Thanks for all your input!i just got my american citizenship last august.i'm here in north carolina.which is i believe has a very strong value when it comes to family thing.this is one of the conservative state in us,i think.i was able to talked directly to the social services"CHILDSUPPORT-ENFORCEMENT AGENT",and they said that they gonna have a meeting with their dept.lawyer about jurisdiction,since my husband is still in pinas.

>and yes,my mother-in-law is keep telling me that,she hopes that her son is gonna realize his mistake before its too late...

Hi,everyone!

new member here!i'm going to point right away.i need a free legal help and i hope someone here can....

me and my husband agreed that he's going to pinas,to put up a fishing business,since his work here on sale i slow.but to the promised that he's going to stay with my family the whole time that he's in pinas.but to make it shorter....he ended up moving out from my family and he started doing monkey business as well.no phone calls,and he's not letting me know his phone no.and his address!sounds crazy but that's whta he did!but eventually i found out that he met a girl,and that girl become his companion until now.he lft us june 22,he's still there until now...and probably not planning to back.we have a 5year old son!and he's start looking for his daddy!my mother-inlaw is worried too because his the only and yet we don't know where he is!he's just sending us an email when he wants to ask something.so now i have no choice but to file for abandonment and separation.he got our money,so i'm trying to find a free legal help with this matter...i can't believe until now that my husband for almost 7years is going leave me here in the states!i don't have any family here,except friends.and my mother inlaw.he wants to retire in pinas but i told him,that its too early,he's only 45.and the fact that retiring in pinas is not a big joke!we need to be financially stable first.

please,i appreciate any input.

Most states have a no-fault divorce. You can get the paper work at the city hall in most cases. In Florida the divorce papers cost $16 dollars. Check out your city hall. Once you have the papers send your husban a copy of them. This could be the wake up call he needs. Good luck RMS.

North Carolina is a "NO Fault" Divorce state. It is required to have a one year separation prior to divorce. Any evidence of "being together" during that year period can be grounds to "reset" the clock if one party wants to contest the time period of separation.

12/08/08 6th Visit Medellin (gave "Promise" ring to be exclusive)

1/22/09 - 6/21/09 4 more visits. 6/22/09 GOT ENGAGED!

9/19/09 12th Visit Met in Medellin for Dial Del Amor y Amistad

6/23-7/21 Gathered paperwork and applied for I-129F 7/24/09 USCIS acknowledges Receipt of I-129F application NOA1

9/28/09 NOA2 received!!! Only 66 days! 10/02/09 NSC Received and completed Application and sent to Bogota

10/02/09 Embassy received application (my lawyer is two weeks behind informing me - time line information learned on 10/15/09)

10/09/09 Embassy sent out Package 3 10/15/09 Package 3 not received - downloaded forms from website.

10/16/09 Submitted DS-2100 and Ds-230 to apply for interview date. 10/23/09 Received Interview date (had to call DOS)

12/09/09 Interview - VISA GRANTED!!!!!!!!!!!!!!!!!!!!!!

1/07/10 Arrived in Miami, cleared Immigration with no problems. Arrived in Charlotte to a freaking cold spell 55 degrees colder than Dora has ever experienced.

OMG, govt free legal assistance?.. there must be.Her case is under Women's and Child's Rights. Any state/country supporting Human Rights, more so the Bill of Rights..(sorry for sounding preachy :oops::idea: ) incorporates this into their Implementing Laws mmm :reading:

Old Dominion mentioned above that the government only provides free legal representation in criminal cases through the public defenders office. In a criminal case, you have a RIGHT to an attorney. In a civil case you have no such right. This is because a criminal case involves the government against you, while a civil case usually involves one citizen against another. The government (and taxpayers) are under no obligation to cover the costs of settling disputes between two citizens.

On the other hand, there are private non-profit groups (the Legal Aid Society has been mentioned) that offer free legal advise and assistance. They don't generally provide an attorney to represent you in court - you have to do that yourself - but they will help you with forms, and advise you about the law.

Actually, that is un-true... It's dependent on county suppose.. I know for a fact that my cousin was able to get free legal representation in court due to her income being so low... This was in chicago. I'm not sure who actually provided, but it was court appointed. Her case may have been a little different because there was physical abuse involved...

But your best bet is take a trip to the court house and they would be able to point you in the right direction as they also might have social workers in house for people in similar situations to you...

Individual counties can do whatever they want to do, including providing attorney's for family court cases at taxpayers expense. Lawyers can also do whatever they like, and there may be lawyers in the OP's county that will take a divorce case pro bono in order to gain more courtroom experience.

My comment was in response to the allegation that "Women's and Children's Rights", "Human Rights", or the "Bill of Rights" guaranteed free legal representation in a civil case. There is no resolution by the UNHRC that I'm aware of that guarantees free divorce lawyers. The US Bill of Rights doesn't guarantee it. There is no federal law that guarantees it. And, as far I know, no state laws guarantee it either. If you can get free assistance, by all means take advantage of it, but there is no "right" to a free attorney in a civil case.

If you are a US citizen, then you don't have to worry about any immigration issues. Just get yourself divorced with some of the help suggested in this thread.

Hi, I am sorry to hear about your situation. Your husband is a scumbag.

Depends what your current status is and what you want to do with your marriage you have lots option. If you want to file for separation, you can do that and request for spousal and child support. If you want an immediate support you can file an ex parte. You can also file for divorce which you have an advantage because you are here. If you could not serve him because he is not responding and he is out of country you could apply for default. What state are you? You could also sue him because with what he stipulated with the USCIS if he is your sponsor.

Much of the previous appeal has been destroyed by Dollhouse, Tropix, Crystal Palace and KOREA TOWN. Subic & Baloy Beach area is rockin' even better since the expressway opened!

....until now my husband's friends,my firends and his mother,are still can't believe that he would just abandoned us,for a short period of time!he doesn't even bother to call on our son,who is until now,has no idea what his father did to us!and that's what make s me cry most of the time....as a father how could you abandoned your 5 year old son,for just the reason of screwing around with younger girl.and the fact that he left us,to stay for good in my own country!sounds crazy right?!
