Hi,

We are gathering all the papers to send the AOS. They ask for the most 6 recent paystubs. Unfortunatly 2 (the 2nd and 3rd) are missing and his accountant told him he cannot make any copy. Is it ok if we send some others that will be older of 6 weeks?

Many thanks

I had a similar issue. I was missing the latest pay stubs; i sent what I could and it was not an issue. We didn't receive any RFE's on the pay stubs and we figured that if anything, we would bring the latest paystubs to the interview. Fortunately, our case was sent to CSC, and no interview was done.

AOS

2009-01-12===> Sent AOS packet via UPS
2009-01-13===> AOS packet received
2009-01-28===> NOA's received in the mail
2009-02-01===> Biometric appt received in the mail
2009-02-06===> Completed biometric appt thru walk-in
2009-02-06===> Applied for expedited AP thru the phone
2009-02-14===> Received AP in the mail
2009-02-11===> Case transferred to CSC
2009-02-23===> EAD received
2009-05-02===> Green card received in the mail, no interview done.

Yes. Also if he deposited those paychecks (the missing ones) send a copy of the bank statement also. Copies of these ARE available, no one issues payroll checks and doesn't keep a copy. The payroll checks I issue are THREE part forms, one is the check, one is the check stub for the employee and the other is an identical check stub for my files. The accountant is too damn lazy to stand up from his @ss and get what he needs, or untrained and not interested in learning. I would have a lot to say about that. People are entitled to be lazy and ignorant, but not at MY expense! But you can usually recover form lazy, ignorant, clerks with fancy titles.

Good luck

i wouldn't worry about it too much. my wife's stubs weren't consecutive either. the interviewer didn't seem to care too much. but do try and find some copies.

They ask it for the I864 with transcript of last year taxes and 6 recent paystubs.

Actually they ask for

"You may include evidence supporting your claim about your expected income for the current year if you believe that submitting this evidence will help you establish ability to maintain sufficient income. You are not required to submit this evidence, however, unless specifically instructed to do so by a Government official. For example, you may include a recent letter from your employer, showing your employer's address and telephone number, and indicating your annual salary. You may also provide pay stub(s) showing your income for the previous six months"

but it is something you don't have to supply, it is only if you feel it will help your case. And it is the previous 6 months not 6 paychecks unless of course you are paid on a monthly pay scale.
