this has nothing to do with the National VISA center..... USCIS is a separate entity..

Okay I apologize, I would like to rephrase my question :

Hi guys, I was interested in knowing what happens during the "Initial Review" phase as well as the "Post Decision Activity" phase of the USCIS.

Does the USCIS conduct background checks or the NVC conducts them?

Thanks a lot for all your answers in advance.

Hi guys, I was interested in knowing what happens during the "Initial Review" phase as well as the "Post Decision Activity" phase (that is at the NVC) of the USCIS.

Thanks a lot for all your answers in advance.

"Initial Review" - During this step, USCIS initiates the background checks of the applicant/petitioner and identifies issues that may need to be addressed either during an interview or by asking the applicant/petitioner to submit additional information or documentation. USCIS reviews applicant's/petitioner's criminal history, determines if there are national security concerns that need to be addressed, and reviews the application/petition for fraud indicators.

"Post Decision Activity" - For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

Maybe your understanding is different. Initial review is when USCIS receives your petition and gives it an initial check to see if there are any obvious disqualifying factors, such as you didn't sign the forms or didn't enclose a check for payment. If that happens they reject the whole thing and send it back to you. If they cash your check, you got past that. Then the petition gets in line with 35,000 or so others (per year) and gets adjudicated. Yes they do a background check at that time. Once approved it gets sent to NVC that also does a background check and then it gets sent to the consulate. It can be delayed for "additional processing" at any point in the process.

Unless there's an RFE, initial review includes everything they do between sending the receipt and writing/sending notification of a decision. Getting adjudicated is part of "initial review". For the "right answer", simply place your curser above the dots representing the stages and you'll be able to read the answer. That's what Pizza Dude did for you in his answer.

LOL and I wait for Pushbrk. Thanks. However, if you forget to sign the forms or attach a check, they WILL send the whole thing back post haste!
