K-1 Visa, and sending money to fiance~~~

I was searching through the forums and couldn't find an answer, so I'm posting a question here. (Mods: If there is a better forum, please move.)

I have been in my relationship for 4 years now, and we chose to get married, so we started the K-1 visa process in March 2009, CSC. Anyways, It has been a long time, and still waiting on NOA2, and it seems that my background check is causing a problem, of which I have no idea. Clean record, no arrests, nothing. Then I was talking with a friend, and they asked about if I had sent money to my fiance. So, yes, I have sent money directly to my fiance on many occasions. Mostly when I was travelling on vacation, wiring the money there and taking advantage of a good exchange rate was a good idea at the time I thought. There were also other times when I sent my SO money just to help make life easier for her.

So has anyone had this "Sending Money" issue come up at any time in their visa journey? If so, big issue, no issue, anything?

This is a good question, because I have been waiting for 6 months now and nothing, as I see all of April, May and june now being approved and I am wondering if the money I send my fiance is the problem. I too have send my fiance money every month to make her life easier and all of her money for working is going into the back for all the things needed for the interview etc. I can't wait to hear what people have to say about this.

Aaron,

You said it seems as though your background check is causing a problem? What would make you think this? Were you sent something, or is this just a simple assumption?

If you have no proof or have received nothing regarding your background check, then there is no reason for you to think this has anything to do with the delay in receiving your NOA2.

In regards to wiring money to your fiance, I have never heard of this being an issue. I myself never did that but I have met people on here who have (LOTS of people) who have had NO issues with that whatsoever. Some people argue it's a good idea to include Western Union receipts showing you sending her money because it shows you're attempting to provide for her and take care of her, while others say it's a bad idea because it shows your fiance is relying on you for money and we both know there are too many stories out there regarding a foreign person taking advantage of and using a U.S. citizen for their money and a shot at coming to America.

I will not say either side is right, but it's up to you as to whether or not you want to provide this information.

I am not sure if you SENT the receipts to show that you wired your fiance money, so it'd probably be better if you included this in your response.

If you did not send receipts showing that you sent your fiance money, then this is a non-issue, as there is absolutely no way for anyone to know besides your fiance and you that you sent her money.

The OP said they've been in a relationship for four years now and chose to get married, thus he filed for a K1.

I think we BOTH know that the OP didn't imply that they GOT married THEN applied for a K-1.

Sending money would not impact petition approval but I would not offer evidence of such at a visa interview or with petition filing. It doesn't help and CAN hurt in the evaluation of the relationship bona fides. If asked, of course be honest.

Facts are cheap...knowing how to use them is precious...

I did receive an RFE back in July, sent it back in right after. I guess the money issue was an assumption on my part, because couldn't think of anything that could possibly cause a delay as long as this. Also, did not mention sending money or provide receipts when filing the K1 package.

Depends. My wife had (has) two sons. Part of our process included a letter from the father allowig the children to leave the country and we bribed him with the incentive of reliving him of all child support, past, present and future. My wife and I then had a pow-wow so to speak and did abudget using her income (she was working) my money and all our expenses, here, there and in the future, planned for every expense, travel, AOS, English tutor for our youngest son, you name it. It was, in my opinion, a responsible thing for adults in a relationship to do. So I sent money every month per this budget. She never asked more and would accpet none until we had a budget and she had explained everything she needed money for.

For our interview I brought my WU receitps and our budget plan. They never looked at them and it was a non-issue, we were approved without question and they barely looked at any evidence except a few pictures. I doubt money transfers would be an issue for Kiev, Ukraine, particularly if it was a planned family budget.

That said, there are consulates that will toss you right out for sending money and say you are "buying your bride" or paying someone for her. So in all I see it as something that CAN be very bad and at best a non-issue. I wouldn't mention it.

For a K-3/CR-1 it should never be a problem.
