We just got NOA 2 and have not received packet 3. However I'm asking ahead of time so there are no surprises. Does the New Delhi embassy require the last 3 years of tax returns? I was divorced in 2008 so the years 2006-2007 are going to show my married name and then 2008 doesn't show I had enough income on my own because I had moved and just gotten a job. I do have enough income, more than double what I need for sponsorship. Can I include pay stubs from my employer to prove this? Will all these complications hurt us at the interview?

January 2009 - K-1 Denied by the consulate

January 2011 - Moved to India - Yikes!

October 2011 - DCF filing rejected by overzealous employee at the embassy

December 2011 - Tourist visa denied (not surprising)

March 2012 - CR1/IR1 process started

May 1, 2012 - RFE and some of our information was entered into the computer wrong by the CSC

u should have also a letter from ur employer, i dont know about anyone else but we only have one year of the taxes (last year) also copy of w2, and six pay stubbs,

I'm in a similar situation. The Embassy in Dhaka also requires the past 3 years of tax returns. We have decided to go without a cosponsor and just show pay stubs and a letter from my employer. I'm not sure how this will affect our case. We will have our appointment hopefully in October, so I will let you know how it goes. :)

02/07/2011: EAD Approved

02/15/2011: Received AOS Appointment date

02/16/2011: Received AP document!

02/17/2011: Received EAD!

03/18/2011: AOS appointment (Cleveland Office)

03/23/2011: Received Approval Notice

03/31/2011: Received Green Card! :)

I was married before too and had to submit my tax return that showed married filing jointly last year when we went through this the first time around but didn't seem to be any problem, I just wrote them a statement of explanation, plus I supplied a Co-sponsor as well. I don't know if it helped, but didn't think it would hurt either and I only provided the most recent years IRS Transcript.

Here is the I-134 guidelines from the Delhi website for the I-134. It tells you what you can provide.

AFFIDAVIT OF SUPPORT:

Note: Only U.S. consular officers, DHS officers and U.S. notaries are authorized to notarize form I-134.

Each visa applicant needs to satisfy the consular officer that he/she will not become a public charge. The petitioner must provide a notarized affidavit of support (form I-134), form 1040 and W2 for the most recent taxable year and proof of U.S. citizenship. If the petitioner’s income is not sufficient the applicant MUST submit the above documents from the petitioner along with the same documents from an additional sponsor willing to assume financial responsibility for the visa applicant. See the paragraph below for details regarding these documents.

Form I-134.

Documentary evidence that the petitioner/joint sponsor is a U.S.citizen /U.S. permanent resident (e.g. clear photocopy of birth certificate / certificate of naturalization / U.S. passport / both sides of green card, as applicable).

1. Federal tax return (form 1040) with all W2s and supporting schedules for the most recent taxable year.

2. If the petitioner did not file a tax return, then the petitioner must provide a written explanation of why he/she had no legal duty to file the return.

3. If the petitioner filed a late or amended tax return, he/she should submit evidence of it.

4. If the petitioner does not have copies of his/her tax returns, an Internal Revenue Service (IRS) summary should be submitted.

August 20, 2009- Mailed and Emailed request letter to Embassy to extend validity date of petition.

August 25, 2009 - Embassy received request to extend validity letter.

Sept 2, 2009- Embassy confirmed their receipt of the completed DS-230 and Applicants Statement.

October 29, 2009- 2nd Interview date- Visa Approved!

November 4th, 2009- Received Passport with Visa intact!

December 4th, 2009- Fiance arrived in U.S. - MARRIED Dec. 7th!

February 23rd-Mailed AOS Packet

March 3rd, 2010-Check Cashed

March 6th, 2010-Received AOS Receipt Notice

PS) Ignore where it says about the I-134 needing notarized, the new I-134 does NOT need to be notarized. Just your signature is required.
