Issue:

I have two separate I-130 petition

One for my wife and the other for my 2 years old son.

I, the petitioner,  live with my brother. My brother is going to be a household member sponsor and so we are filling an I-864 for me(the petitioner)and an I-864A for my brother(he household member sponsor) as we live under the same roof. My brother is divorce and have a son. So with me, my brother,my wife(the immigrant), my son(immigrant) and my brother's son, the total household size is 5.

So I am putting the following, please can anyone confirm that I am correct.

21a. 01 - (wife)immigrant

21b. 01 - petitioner

21c. 00 - although married, I assume 0 is correct.

21d. 01- my son,  although I filled an I-864w for him ( he have a separate I-130 petition)

21e. 02 - my brother's son

21f. 00

21g. 01 - Brother is co-sponsor

21h. 05 - total household size  

If I am correct, I am almost done. Only one more question:

In my brother's I-864A in Part 2. Sponsor's promise, question 13. :

asking to indicate number of intending immigrant, do I have to put 1 or 2 although I complete a I-864w for my son and then write my wife's name and my son' s name in 13a. and 13b.

21e. 02 - my brother's son Depends. Do you support the kid financially? Did you claim him as a dependent? (if the answer to either is yes, then yes.)

21f. 00 assuming this is true, looks ok

21g. 01 - Brother is co-sponsor yep -- 1

21h. 05 - total household size  I count 4, unless you support your nephew.

In my brother's I-864A in Part 2. Sponsor's promise, question 13. :

Just your spouse. You are doing another I-864a for your son.

thank you very much brlukath for your answer, I am confuse when you say that I am doing another I-864A for my son, do I have to complete a I-864W and an I-864A for my son I thought it was only an I-864W . thanks again.

Did you sent I864a already..I am stuck on same topic as well.

On I864 I am petitioner and Mother is Intend Imm. On Part 3 #8 I selected " I am sponsering then Yes "

I dont add anymore names because she is already above.

I dont earn money to support my mother so I am adding I864a for my husband who lives with me. Is this correct?

I am assuming I dont qualify for I864ez

Part 2 on LIne 13 of I864a Its my husband's name then One (on blank) add Mothers name line "A" and last

Part 3 husband's name again and one (on blank).

Its this correct?

About Income Taxes: Since we are married filing jointly we need only 1 copy per year???

i am the petitioner,and will file I-864 for my son, but as of now i'm unemployed so ask my daugther to be a co-sponsor, so I prepare I-864A, my question is, does my daugther has to have her own I-864, or just the I-864A alone will do?Please help me out on this one. ..... Thanks ahr888 :unsure:

If your daughter lives in the same household as you she file 864a. If not she needs 864

Petition I filed for my mom was approved. Now I need to send Affidavit of Support. As long as I'm a full time student, my income for 2008 is very minute. Therefore my husband will fill out form I-864A. I got stuck at #11, where my husband is asked about his adjusted gross income in form 1040 EZ. We don't have such a form at all. We only have 1040 (is that the same form or substitute?). Also, if we filed jointly, adjusted gross income in #37 of IRS Form 1040 shows my husbands income or both our incomes?

For those that are living with a household member and filing I-864A did you send any evidence with the I-864A proving that you do live in same home and they are a family member? I am living with my father who is also the joint sponsor and the embassy sent back the I-864A saying its wrong form they need I-864 so I confused about why they did this
