I filed my I-29 visa last month, mid-August, for my pregnant Colombian fiance, they cashed my check and sent me a reciept. I would love to have the child in the United States, to be there for the birth and make evrything a lot easier. I filed for a petition to expedite the process so that she could have the baby in the States, she is due in February. They sent me a letter tonight stating that the petition has been denied becasue it did not meet criteria, one of the criteria under special interest to the USCIS is medical. I though pregnancy might have something to do with medical or be at least special interest. I guess I was wrong.

The California Service center says the I-29 takes 5 month to aprove. After I am aproved for the I-29, how long will it take to schedule an appointmenet with the US embasy in Bogota? How ong will it take her to be approved for the K-1 visa. I am sure it will be outside her due date and I will miss my first child being born, because I have to stay and live here in the US working.

If anybody can give me an estimate of the timeline and what I can do to make things flow smoothly an quicklt, that would be great.

About the only reason a k-1 ever gets expedited is for military deployment to combat areas. Definitely NOT for pregnancy, if they did that 85% of fiancees would be pregnant instead of 35%

They are pretty consistent in not granting expedited processing due to pregnancy. If that worked everyone of child bearing age would use it to jump to the front of the line. When they refer to medical they are almost always referring to a condition the USC suffers from that is made better by rapidly uniting the parties involved.

This will not be over quickly. You will not enjoy this.

We are too are going through the same process, and I too, was pregnant, with our second child. I did not file for an expedited case, and according to my lawyer, it probably would not have been approved anyway. I started the process for my fiancee on January 28, and we had the interview at the embassy in Bogota on August 25th. We have to go back for a second interview with DNA results for both of our children and my fiancee to prove that he is their father before they will grant us the K1 visa. I think, that if all goes well, we should be going back to the embassy in approximately a month or so. By the way, our daughter was born two days ago, and everything went perfect. Daddy wasn't able to be here, but God is great, and we will be together soon to start living together as a family!!!! Can't wait!!! Keep your chin up and don't get discouraged. I have all of the hope in the world!!!!

Best wishes to you and your fiancée, stvcoburn. We got lucky with our K-1 (honestly, I don't think there's anything special anyone can do ... we just did the best we could and sent it in, nothing significant); here's hoping some our luck rubs off on you! :)
