Timeline

What is advisable? fill the NR-73 or advise CRA when I file the tax forms for 2009 that I'm gone, byebye?

I've read that filing the NR-73 was not necessary and it gives CRA the chance to refuse non-resident status for tax purposes depending on the answers to the NR-73 Questions, and that it was better to file the a tax return for the current year and never file another return ever again.

09/22/2006 - Received at NSC
09/28/2006 - NOA-1 (1-797C date )

10/02/2006 - Cheque cashed

10/02/2006 - NOA 1 (I-797C recieved in the mail)

12/08/2006 - NOA-2 in 79 days

12/13/2006 - NOA-2 hard copy recieved

12/26/2006 - Package recieved by NVC

12/30/2006 - Received by Montreal

01/22/2007 - Received Packet 3

04/16/2007 - Returned Packet 3

08/02/2007 - Received medical documentation

08/07/2007 - Received Interview date Aug. 9th

08/09/2007 - Received I-601 and 212 (not approved yet)

02/17/2008 - I-601 approved 212 abandoned

06/2?/2009 - New medical and passport and doc sent to Mtl

07/22/2009 - Recieved request for DS-221 and notarized letter of intent

07/31/2009 - Montreal recieves thier final requested doc.

09/01/2009 - Visa approved and mail out today

I never filled it out. I actually called up revenue Canada and asked, and that rep said it was NOT a must! So why bother with more useless paperwork,lol Now cassie's "accountant" said she HAD to do it! I think he got his degree from the back of a shreddies box though,lol

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

I think I went to the same university as Cassie's accountant. :wacko: I think it is much better to not do the NR-73. I"ll ask my daughter also, I love her very much but she's a very low level bureaucrat at CRA in International Taxation so if anything goes wrong it will be her fault.

I didn't fill one out either - I suppose it might be helpful if someone had a really complicated tax issue and they were trying to claim residency or non-residency and it was being disputed.

Otherwise - I think it's probably a waste of time.

I did fill that out and my only advice is be careful how you answer the following question on pg 2:

Are you subject to income tax in that country on your world income? (total income from inside and outside Canada)

I made the mistake the first year of saying No, because in my mind the IRS had not taxed me - they exempted my Canadian income. Where in truth, I should have said YES I was subject to tax (even though the IRS allowed me to exempt it)

I screwed myself because they deemed me a 'Factual resident' of Canada which meant I was taxed differently and I paid more then I've ever paid, even when I lived in Canada (fact was I had lived for 11 months in Canada, 1 in the US that year)

I don't think it's a bad thing to fill it out, but do it early in case you need clarification before filing your taxes next year, that's the only advice I'd give.

On the very first page of the Cdn tax return, it asks you when you became or CEASED to be a Cdn resident, jot down the date there! thats all I did! and for fun, I applied for the GST credit,lol, even though I knew I made too much $$$$ while in canada, and as a non-resident,I was not entitled to it. BUT, I did get a letter from them saying my GST credit was denied based on being a non-resident of Canada!! I don't belive they send you anything that you are now in fact a non-resident of Canada!

Exactly and if they deem you anything otehr then a non -resident, you have to fill the same form out the next year if you want it to change!. I have a big hate on for CRA

Yeah Ron, I just made a notation on my tax form the following year of when I wasn't a resident any longer. Didn't do that NR-73 at all. Isn't if FUN to be worrying about this kind of stuff now instead of that other stuff!!!! :yes:
