Wrong data on green card

Yesterday I received my new 10-year green card and there was much rejoicing. Until I noticed that next to 'resident since' it says 06/01/09, instead of 08/26/07. June 1st was the date of our I-751 receipt and obviously someone was not paying much attention to what they were doing.

I was told that I-90 is the way to go with this, and that if this is a USCIS mistake I won't have to pay the $290. But the form says to include a check/money order. Soooo, what do I do? Put in a check and hope that they won't cash it, OR not include a check and run the risk of them sending it back because it doesn't have the required fee?

I did a search, but couldn't find anything about my fee dilemma. If someone has experience with this, I would love to hear how they solved it. Thanks!

On Page 3 of the instructions (What is the Filing Fee?) - it lists 3 exceptions, one of which is the reason you indicated (a mistake on their part) so no fee is required.

I guess I needed someone else to tell me not including a check will be fine, because I feel much better now and will stop worrying :)

Danke!

I would include a copy of the instruction and highlight the section that talk about the error, etc. And don't send the check.

You can also include a brief cover letter stating you are requesting the data error to be fixed, and something like "as per instruction, section XXX, a error was made and no fee is required". Sorry, don't know exactly how it appears in the form, just make sure you include it. :-)

And make sure when you send the I-90 and incorrect GC, you get signature confirmation of the delivery. After AOS we had to send my husband's back due to a spelling error. USCIS claimed they never received it, but I had the confirmation that they did.

I would not have thought about the signature confirmation and I'll include a short cover letter as well. Thanks, Meriem and nycbra :)

Hi Erica,

I just saw the I-90 and it says "Include any documents that support your claim with your application". So I guess you should also include a copy of a document that shows/prove the data on the GC is incorrect.

"Your Permanent Resident Card was issued with incorrect information because of a USCIS administrative error.

In both of these instances, you must prepare a Form I-90. On the first page of the application, under Part 2, Application type, Number 2, Reason for Application, check box "b" which reads: "My authorized card was never received," or box "d" which reads "My card was issued with incorrect information because of a USCIS administrative error." Include any documents that support your claim with your application.

For those applicants who check box "b," you must send a copy of your Form I-797, Notice of Action, that you received for your previously filed Form I-485, Form I-751, or Form I-90.

For those applicants who check box "d," you must submit the original Form I-551 card containing the incorrect information that supports the requested correction."

Hi,

I've made copies of my 1st GC that has the right date on it, and also a copy of the recent approval letter which states the 8/26/2007 admission date as well. I don't think I have any further evidence (though I'll search some more), but I'm hoping that with both of those they'll see the error of their ways ;)
