Hello

I am a new member and have been reading this board for a long while now.

I found this board through an online search for immigration forums.

I have been reading extensively, and just want to make sure that I have a clear understanding of a few things.

My fiance is from Iraq, and working in Italy. We have filed the K1 papers, but now he does not wish to return to Iraq for the interview. He wishes to become a permanent resident of Italy. Can we re-route the petition to Italy once he becomes a permanent resident? Or will we have to begin the process all over? And, if I am not mistaken, since we have already filed the K1 petition - would we now have to wait 2 years before applying for another visa?

If I understand correctly he doesn't want to go live with you in the United States but want you to live with him in Italy?

I don't know much about people giving up on K-1 petitions. I know there're lots of answers in the Guides that will help you.

Welcome to VJ, it is my understanding as long as he is legaly in Italy, he can have his interview there. My fiance is a citizen of Pakistan, but resides in South Korea on a student visa. His interview will take place in South Korea. I hope this helps you some

Hi welcome to VJ. My fiancee is also from Iraq, but will do her interview in Jordan. Reason is Iraq is not the safest place right now and getting to the embassy there might be rather difficult. . You could also call the service center and see what actions you have to take to change your fiance's interview location. I too thought about changing my fiancee's interview to Germany, but decided not to because I do not want to cause any delays or chance the paperwork getting lost in the process with an address change.

Sorry can't help you. Have you read the guides and didn't find anything or tried to call USCIS to get more info about how you should proceed? I'm sure if no1 can help you here you can always try to call the Service Center that's dealing with your case, I don't know which because you don't have info on your profile.

If your fiance is legally present in Italy (work visa?) he doesn't have to become a PR to have his visa processed there. Did you put his Italian address on your petition?

Usually the Consulate requires tht the applicant have 6 months forward legal stay in a 3rd country before they accept the case. Is your fiance scheduled to leave Italy soon? Can he get a further year's extension on his work permission?

If he is not there legally, he will probably have to interview in one of the alternate posts---Ankara or maybe Nicosia? Are they even conducting interviews in Iraq right now?

Mr./Mrs. meauxna... to be honest, my fiance WAS in Italy legally to work. When his work visa expired, he stayed illegally. Now, his passport is stolen and he is afeared to return to Iraq to try for interview because he is ascared that he will go to jail because he overspent his time on the work visa. So he said to me that he wants to try to become permanent resident of Italy now. ONce he becomes permanent resident, he can have another passport. Will we have to do another K1 petition? Or will we have to wait 2 years like as i read?

Wind Dancer, I think your case is going to be difficult--you might want to find some help, maybe through the Iraqi community in the US.

I don't know the rules in Italy, but other European countries I have lived in are like this:

#1: you can not become a Permanent Resident just because you want to. Like the US, you must qualify under one of their conditions.

#2: Without a valid passport, he is going to find *any* immigration difficult/impossible. He must renew his passport & I have no idea what is happening with Iraq right now.

#3: Italy will be even less excited to talk to him because he is there illegally now and has no reason to stay.

#4: Being a Permanent Resident does not qualify one to get a passport from that country. I had PR in Greece; it allowed me to live and work there legally but I did not get a Greek passport. In the US, a PR may live and work legally, but they do not get a US passport.

Did you put his Italian address on your petition? Is it possible his interview will be in Italy?

I think you need solutions beyond what people here know. Perhaps a refugee or asylum orgainzation, or as I said, someone in the Iraqi community can help you?
