hello everybody! I`m new here. i hope somebody can give advice regarding my query.

i have been issued a k1 visa early this year. Went to the USA on my k1 visa to be with my fiancee but I went home after a month. We did not get married that time because there were some issues financially and a lot other things that`s why we decided that I go back home first until he resolves everything. We`re planning to apply for a visa to go back again next year and this time we`re ready to get married.

My question is will there be a problem if my fiance petition me again for another K1 visa since I already went there on a K1 before but with the same petitioner? Any advice please... thank you.

No, there shouldn't be any problem. Just be prepared to explain at the interview what happened the first time. I'm truly glad that you didn't marry and worked things out beforehand! Best of luck! (F)

I do hope things work out for you next time. You shouldn't have any problem getting the 2nd visa, just have petitioner write a brief letter explaining what happened, and he will include that in the next visa application packet.

ps, Im also glad that you phrased your post the way you did. Anyone who says they were "sent back" home gets blasted around here by those who get set off by use of that terminology.

I respect the fact that you both chose to wait instead of tying the knot simply because you traveled to the US.

You'll face some extra questuins at the interview, but you have a good explanation for what happened and you did everything legally, so there should be no problems getting another visa.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

LOL! Reminds me of the line we hear from Filipinos "proud to be pinoy"... but please don't sent me back to the Philippines. They leave off the "but."

I was once in US under k1 visa too. but didnt get married because of some uncertainties regarding my fiances business. so i went back here. now that we've settled this uncertainties we decided to apply for k1 visa again so we can finally get married, we are now on the process of k1 visa for the 2nd time around.. now waiting for NOA2. :whistle:

if this is the second time for your k1, i sure hope you have MORE evidence of ongoing relationship between the time you went back here in the Phils until your second application for K1 visa. emails, pictures, cards, snail mail, phone bills (not phone cards), IM's etc (you get the gist).. coz most likely thats what they will look for. not evidence of engagement but evidence of continuous relationship despite the wedding that went kaput. ^_^

we're already on the second step of the process and well, i can be such a worry freak sometimes and it's normal for me to think of "what if's" -- what would i do if things go wrong and such. after reading your query, i placed myself in your shoes and what i would do is i'd have the wedding here in the philippines instead and then apply for a k3 visa. since it only takes 5months to process, just like a k1 visa.(5months)

and since CSC is actually on track right now and doing well, i wont worry about delays. just a suggestion ;)
