Now that we are remarried what should we do next since i was not issued with a NOID/NOIR. I am so confused. I contacted the embassy they said i will have to refile there is nothing they can do to help me rectify my situation.

Why did you need to re-marry, was your first marriage not good enough? What exactly was told to you at the consulate? Was this after a visa interview, for a spousal visa? A little background would be helpful...

If you need to re-file, then you just complete the I-130 and send to USCIS to start the process...basically start from the beginning again.

Sorry i deleted my old time line any way. I got married in 2004 and then my wife and i got two kids she live out side the US i registered the birth and the became citizens. I then applied for me wife and she had a Ir1 interview on 22 June . I was with her they told us that she was not iligible for the visa even tho they know we have a real relationship. they said the marriage was not valid due to us getting married 1 week earlier than we should have due to an unfinished divorce petition at the time but i was told by the judge i can go ahead and get married so we did. And we were told our case was returned to USCIS the next week. That our said story,. And our kids and my wife most of all is in so much grief. I was hoping to have them by my side at this time.

Sounds like you will have pretty much of a slam dunk from here on. I guess Ling Che's NVC shortcuts would speed things up.
