Hey guys. I'm 28 years old, and I'm a British citizen in the midst of getting my K1 visa so I can marry my awesome fiancee (appledrop on the forums). I've never had any dealings with the police in my life.....right up to 2 weeks ago where something absolutely ridiculous happened and I got a warning for assault.

Now, I am expecting my interview at the embassy very soon and I'm totally stressed about this. I know it's only a warning but can someone reassure me that this isn't going to affect things?

The ridiculous thing is, there's a question on one of the forms that asks if I've ever been arrested for anything even if it was pardoned. It's in the same section that asks at the same time have you ever trafficked drugs or been a pimp or a #######.

Seriously. So from now on, do I have to tick "YES, I have been arrested and/or have trafficked drugs and/or am a pimp and/or #######" ??

They shoud go ahead and ask, "Do you like cake and/or drink the blood of innocent children?"

Any advice will be appreciated, of course.

If you weren't arrested then there's no problem. You weren't convicted of a crime so there's nothing to worry about.

TIMELINE:

December, 2008 - Started talking on plentyoffish.com

March 25, 2009 - Left Australia to to meet her

March 28, 2009 - Finally met in person!!

April 30, 2009 - Engaged

May 4, 2009 - Returned to Australia

June 26, 2009 - Filed I-129F

July 6, 2009 - NOA1 Received

July 25 - August 12, 2009 - Janet visited Simon is Australia for 2 and a half magical weeks. Met the family and is loved by all of them! :)

September 18, 2009 - NOA2!!!!!

September 28, 2009 - NVC Received

October 1, 2009 - NVC Sent

October 7, 2009 - Consulate Received

October 14, 2009 - Medical

October 17, 2009 - December 8 - Simon visiting Janet in the U.S

December 11, 2009 - Packet 3 sent

December 18, 2009 - Packet 4 received

January 12, 2010 - Interview date

January 14 2010 - Visa Received

January 23 2010 - US Entry

February 7 2010 - Marriage

At least, your event is fresh. You should get no troubles to get some kind of document saying you got released with no charges.

I think you can relax, when you filled out the forms there was no reason to check yes and being arrested doesn't mean much to the Embassy as long as you weren't charged and/or convicted and have the data to back it up.

Definatly apply now for a new criminal records check so that you can use it for your AOS and GC removal of conditions. Also like the above poster mentioned if you could get the police to give you a paper stating you were not charged and/or convicted. You could also ask them to include that you have never been found guilty of drinking the blood of innocent children, being a pimp or a #######, that however might be gratutious

From the I-129F instructions:

If you have ever been convicted of any of the following crimes, submit certified copies of all court and police records showing the charges and dispositions for every such conviction.

It doesn't say if you were ever arrested, lied about by an ex just to get you in trouble, had someone accuse you or you like cake and/or drink the blood of innocent children...etc....it says CONVICTED

Now as was pointed out earlier you will need information at the AOS and GC stage because the requirements are a little different.

If you have ever been arrested or detained by any law enforcement officer for any reason and no charges were filed, submit:

An original official statement by the arresting agency or applicable court order confirming that no charges were filed.

After further investigation, thinking ahhhhh he is the beneficiary.

The DS-156 which is the one your speaking of and not the I-129F says...

Have you ever been arrested or convicted for any offense or crime, even though subject of a pardon, amnesty or other similar legal action? Have you ever unlawfully distributed or sold a controlled substance(drug), or been a prostitute or procurer for prostitutes?

I would get any paperwork you can JUST IN CASE they ask for it and answer the question as yes you have been arrested. It's better to have all your information ready instead of being surprised and caught off guard at the interview.

If you weren't arrested then there's no problem. You weren't convicted of a crime so there's nothing to worry about.

I was arrested. They said I was charged with assault but, when they realised the circumstances were ridiculous, in the end I only got a warning.

So you were arrested and not convicted. OK, no problem for the visa. Get copies of the police record on this, even if it just a ticket or whatever as you may have to provide copies of this. Shouldn't affect the visa at all.
