I'm a canadian who got a k-1 fiancee visa to move to the states. i got a physical in nov 2008 for that k-1 visa. i thought k-1's didn't need physicals to apply for their greencard once married. i sent in my vaccine records along with my green card app in april 2009 but today i recieved a letter stating i need to get another physical before they can process my green card app. is this true or did they make a mistake?

please help.

Did you submit a I-693 from a USCIS designated civil surgeon with your application?

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Basically if you have had physical within the past year you only need to submit the I-693 from a civil surgeon.

Normally K-1s do not require another medical if they have had one within the year prior to submitting their AOS. The only time that changes is when USCIS asks them for another medical. Generally, it means they have probably lost the medical file :( . Look closely at the RFE - is it for the full medical, or is it for the Vaccination part of the 693? You do need to submit an updated vaccination section of the 693 from a US Civil Surgeon showing you have completed all vaccination requirements prior to filing for the AOS. If it is for the full medical, then yes, you will need to do the full medical again. If it is for the Vaccination Component of the medical then you only need that part filled out and submitted.

I did submit the vaccination form from the civil surgeon. the letter i received from the gov't confirmed that they had recieved this. my last physical was nov 2008 so i was under the impression that i didn't need another.

is there anyway i can contact them?

Yours sounds like so many other cases where your medical documents (brown envelope at POE) did not meet up with your AOS file. They can't approve you without something medical to review. You immunization was fine and is not questioned, but the HIV, TB, etc tests are not there. It's next to impossible to get that brown envelope from wherever it has been misfiled or misplaced. Your foreign medical office probably didn't keep a copy, but you could try that. The bottom line is you have a certain number of days to get something medical to the USCIS and the quickest way to do that is go have another exam. If you don't respond to the RFE on time, they can deny the case for lack of enough information to approve it. Many have tried to find that lost medical but it normally doesn't work out.

Just want to add that you can take up the cause and fight this by responding to the RFE that your turned in a medical at POE. You can insist that they look for it. You response ought to put your case as pending over a denial since you did respond with a volley back to them. You can contact your Congressmans immigration aide and get the Congressman to insist that the USCIS is in possession of your documents and they should locate them. But that could take many, many months and they still might not locate the brown envelope. If you just want your green card asap, then get another exam and get on with your life as a US resident.
