We got our marriage license 2 weeks ago and have locked it away for our wedding day : ) ever since. This morning as we were getting ready for the ceremony which will take place on Monday in the City Hall, we realized that the city clerk made a mistake about my fiance's Birth Place. She was Born in Taiwan, not China. But on the marriage license it is typed: China Taiwan. We wonder if we should go and correct the mistake now, or it does not really matter. We just do not want any problems down the road since we are to mail out the AOS package as soon as we get married.

Well, since China considers Taiwan part of the mainland, I don't think it's a mistake. (as the clerk sees it)

I don't believe it will cause you an issue down the road, everything I have seen from the US government shows they really don't split the two (not to step on either ones toes)

Perhaps someone with some China experience will chime in :)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

What does the bio page of her passport say about place of birth? That may not help either, it probably lists only the city of birth.

Older (pre-2003) passports said "Passport of the Republic of China" in both Chinese and English, the post-2003 version shows "Passport of the Republic of China" in Chinese and "Republic of China Taiwan Passport" and was introduced by the former DPP administration to annoy Beijing. After KMT regained control of the government, the official position has returned to KMT's long-held view that Republic of China includes mainland and Taiwan province.

I doubt the phrase "China Taiwan" is in a database the city clerk used, he or she may have simply copied it from the cover of the passport. It should be either Taiwan, ROC or just Taiwan. As far as immigration is concerned, People's Republic of China and Republic of China are treated as two separate entities.

But the truth is, you need to make sure everything is correct, because you never know what hassles you will have to go through if the USCIS (or any gov't offices) decide to nail you on that later.

A friend of mine is from India. They misspelled his name on his visa. He had been in and out of the US a few times without any problems. However, recently he is trying to get an H1-B visa, and got nailed on this.

They first told him to contact the US Custom for the name correction. But the USC told him it is the responsibility of USCIS. So he sent an application to the USCIS for the name correction along with $300+. They cashed the check and sent him a note back, saying it is a job for the USC, and the note specifically says "please be advised this notice is a rejection, not a pending case notice" or something of that sort.

So now he will have to head back to India, apply for a new visa while there.

What did you end up doing with your marriage license?

(I was super "paranoid" and checked it over and over again before I left my clerk's office, as they told me that I'd have to go through the court for name change...but not sure what happens if it's "their mistake" assuming it's their mistake).

BTW, my marriage cert says TAIWAN only. Just curious.

I would call the city clerk, it is just a license and you will have to have it recorded so more than likely you can fix it then. But since you will be there at the city hall to be married go early and stop by the clerks office.
